【摘要】：新形勢(shì)下,我國對(duì)官員腐敗的打擊呈現(xiàn)高壓態(tài)勢(shì),因而對(duì)相關(guān)犯罪要件進(jìn)行研究確有必要。受賄罪是較為常見的一類犯罪,而"收受型"受賄罪以"為他人謀取利益"為成立要件之一,理論界對(duì)此要件之存廢有較大分歧。探討"為他人謀取利益"這一要件存在的必要性,有利于完善國家相應(yīng)立法,打擊國家工作人員的受賄腐敗行為。
[Abstract]:Under the new situation, the crackdown on official corruption in our country presents a situation of pressure, so it is necessary to study the relevant elements of crimes. The crime of accepting bribes is a kind of common crime, and the crime of accepting bribes takes "seeking benefits for others" as one of the constitutive requirements. To probe into the necessity of "seeking benefits for others" is helpful to perfect the relevant legislation of the state and to crack down on the bribery and corruption of state functionaries.
