【摘要】：經(jīng)濟(jì)體制改革的核心問題是處理好政府與市場的關(guān)系,要著力解決市場體系不完善、政府干預(yù)過多等問題。非法經(jīng)營罪無限擴(kuò)張適用趨勢是國家對市場經(jīng)濟(jì)過度干預(yù)的表現(xiàn)之一,違背了罪刑法定原則和刑法謙抑性原則,也有悖于市場經(jīng)濟(jì)發(fā)展的內(nèi)在需求。1997年《中華人民共和國刑法》(以下簡稱《刑法》)設(shè)置了非法經(jīng)營罪,采用了空白罪狀與兜底條款相結(jié)合的立法技巧。可是隨著市場經(jīng)濟(jì)的發(fā)展,市場失范行為激增,非法經(jīng)營罪的立法規(guī)定似乎不能“從容”應(yīng)對。特別刑法、若干司法解釋的出臺,擴(kuò)大了該罪懲治的行為類型。然而,該罪的內(nèi)涵和司法認(rèn)定并沒有因此而變得清晰反而增加了難度。我們不得不反思非法經(jīng)營罪的界限,以及把防止其被無限擴(kuò)張的問題當(dāng)作當(dāng)務(wù)之急。非法經(jīng)營罪條文內(nèi)容的模糊性表達(dá)、兜底條款外延的擴(kuò)張、司法實踐對該罪條文的誤解和濫用,都是此罪現(xiàn)在存在的問題。因此,從立法上明確非法經(jīng)營罪的內(nèi)涵和外延,科學(xué)合理界定“國家規(guī)定”,嚴(yán)格限縮兜底條款的外延,明確“情節(jié)嚴(yán)重”的認(rèn)定標(biāo)準(zhǔn);從司法上進(jìn)一步明確非法經(jīng)營罪的適用條件,限制非法經(jīng)營罪的擴(kuò)大化司法解釋,嚴(yán)格司法自由裁量權(quán)的行使。
[Abstract]:The core problem of economic system reform is to deal well with the relationship between government and market, to solve the problems of imperfect market system and excessive government intervention. The trend of unlimited expansion and application of the crime of illegal operation is one of the manifestations of the state's excessive intervention in the market economy, which violates the principle of legally prescribed punishment for a crime against a crime and the principle of modesty of the criminal law. In 1997, the Criminal Law of the people's Republic of China (hereinafter referred to as "Criminal Law") set up the crime of illegal operation, and adopted the legislative technique of combining blank crime with the underlying clause. However, with the development of market economy and the surge of market anomie, the legislative provisions of illegal operation crime can not be dealt with in a leisurely manner. Special Criminal Law, the introduction of a number of judicial interpretations, the expansion of the crime punishment of the type of behavior. However, the connotation and judicial determination of the crime did not become clear but increased the difficulty. We have to rethink the boundaries of illegal business crime and make it a top priority to prevent its unlimited expansion. The vague expression of the content of the illegal business crime, the extension of the underlying clause, the misunderstanding and abuse of the criminal provision in judicial practice are all the existing problems of the crime. Therefore, we should clarify the connotation and extension of the crime of illegal operation in legislation, scientifically and reasonably define the "state regulation", strictly limit the extension of the clause of shrinking bottom, and make clear the criterion of "serious circumstances"; From the judicial point of view, we should further clarify the applicable conditions of the crime of illegal operation, limit the expansion of the judicial interpretation of the crime of illegal operation, and strictly exercise the judicial discretion.
