【摘要】：近年來,我們?cè)诜锤I(lǐng)域常常聽到一個(gè)詞匯——“職務(wù)犯罪”。“職務(wù)犯罪”泛指國家公職人員利用職務(wù)之便實(shí)施的犯罪行為。職務(wù)犯罪腐化社會(huì)風(fēng)氣,破壞黨群關(guān)系,侵害人民群眾的財(cái)產(chǎn)和生命安全,誘發(fā)社會(huì)矛盾,已經(jīng)成為影響經(jīng)濟(jì)發(fā)展和社會(huì)和諧穩(wěn)定的重要因素。隨著刑罰輕緩化趨勢的發(fā)展,職務(wù)犯罪案件判決輕刑化問題逐漸凸顯出來,通過數(shù)據(jù)分析顯示,在法院審判過程中適用緩刑和免刑的比例過高,也會(huì)出現(xiàn)不當(dāng)認(rèn)定自首等情節(jié),嚴(yán)重影響了刑法的權(quán)威性和統(tǒng)一性,大大降低了“犯罪成本”。這種趨勢已經(jīng)引起了公眾的廣泛關(guān)注,要想徹底處理好反腐敗工作就必須解決好職務(wù)犯罪案件輕刑化這個(gè)問題。 本文著重分析職務(wù)犯罪案件輕刑化問題的四個(gè)部分,第一部分是文章的緒論,闡述本文的寫作背景,目的和意義,進(jìn)行了研究這一領(lǐng)域的研究綜述,還對(duì)職務(wù)犯罪相關(guān)概念進(jìn)行了界定。 第二部分從職務(wù)犯罪的危害性分析其特征,從根源上找到這一問題本質(zhì)特性,進(jìn)行有針對(duì)性的分析,以此為鋪墊引出職務(wù)犯罪案件判決輕刑化問題。 第三部分尋找職務(wù)犯罪案件判決輕刑化的成因：一是職務(wù)犯罪近年來具有的高智能化特點(diǎn)所致,二是立法層面的缺陷,三是司法層面的法官自由裁量權(quán)問題,四是法律監(jiān)督機(jī)制的不健全。 第四部分主要是尋找職務(wù)犯罪案件判決輕刑化問題的對(duì)策,針對(duì)第三部分的成因來尋找相應(yīng)的對(duì)策,即從職務(wù)犯罪本身,從立法、司法和監(jiān)督機(jī)制方面找到解決的方法和途徑。
[Abstract]:In recent years, we often hear a word in the field of corruption-"duty crime." The term "duty crime" refers to a crime committed by a public official by taking advantage of his position. It has become an important factor to affect the economic development and social harmony and stability by corrupting the social ethos destroying the relationship between the Party and the masses infringing on the property and life safety of the people and inducing social contradictions. With the development of penalty mitigation trend, the problem of light punishment in duty crime cases is gradually highlighted. Through data analysis, it is shown that the proportion of probation and exemption in court trials is too high, and there will also be circumstances such as improper identification of surrender, etc. It seriously affects the authority and unity of criminal law and greatly reduces the cost of crime. This trend has aroused widespread public concern, if we want to deal with the anti-corruption work thoroughly, we must solve the problem of light punishment of duty crime cases. The first part is the introduction of the article, which describes the background, purpose and significance of this paper, and summarizes the research in this field. It also defines the concept of duty crime. The second part analyzes its characteristics from the harmfulness of duty crime, finds the essential characteristic of this problem from the root, carries on the pertinence analysis, in order to pave the way to lead to the problem of light punishment in the case of duty crime. The third part is to find the causes of light punishment in duty crime cases: first, because of the high intelligent characteristics of duty crimes in recent years, second, the defects of legislation, third, the judicial level of the issue of discretion of judges. Fourth, the legal supervision mechanism is not perfect. The fourth part is mainly to look for the countermeasures of light punishment in the case of duty crime, aiming at the causes of the third part to find the corresponding countermeasures, that is, from the crime itself, from the legislative, judicial and supervisory mechanisms to find ways and means to solve the problem.
