【摘要】：程序性構(gòu)成要件要素是指刑法中規(guī)定的作為構(gòu)成要件的有關(guān)程序性要素。它具有二次性和后續(xù)性的特征,必須是法定的構(gòu)成要件要素。發(fā)生犯罪的特定時空條件,行政處罰、行政許可和告訴才處理等刑法中純程序性規(guī)定不屬于程序性構(gòu)成要件要素。程序性構(gòu)成要件要素類似于國外刑法中的"客觀處罰條件"。在司法適用中,程序性構(gòu)成要件要素要注意隱性的程序性構(gòu)成要件要素、合法實施及證據(jù)證明問題。在立法改進上,不必要的程序性構(gòu)成要件要素應(yīng)該取消,個別犯罪可通過準(zhǔn)確歸位避免程序性構(gòu)成要件要素的設(shè)置困境,部分法定犯可考慮增添程序性構(gòu)成要件要素。
[Abstract]:The elements of procedural constitutive elements refer to the relevant procedural elements as constitutive elements stipulated in criminal law. It has the characteristics of secondary and subsequent, and must be a legal element. The purely procedural provisions in criminal law, such as the special space-time conditions of crime, administrative punishment, administrative license and the handling of telling, do not belong to the elements of procedural elements. Procedural elements are similar to the objective punishment conditions in foreign criminal law. In judicial application, the elements of procedural elements should pay attention to the hidden elements of procedural elements, legal implementation and proof of evidence. In the legislative improvement, unnecessary elements of procedural elements should be abolished, individual crimes can avoid the difficulties of setting elements of procedural elements through accurate placement, and some statutory offences may consider adding elements of procedural elements.
