新中國刑法立法方式的知識路徑選擇及其反思

【摘要】：正新中國成立后,刑法立法經(jīng)歷了多種發(fā)展形式。對于這些形式所依賴的知識路徑,在學界缺乏必要關注。本文在此談談個人看法,并期望總結出一些對今后立法形式有價值的觀點。一、作為革命與斗爭工具的刑法新中國成立對于法律的最重大歷史事件就是拋棄了國民黨時期的六法,從而客觀上形成了無法可依的局面。新中國既無能力,也缺乏必要條件制定刑法典。但在當時的環(huán)境下,國家還面臨美國侵略的威脅,國民黨殘余勢力還在蠢蠢欲動,因此,許多人意識到必須學習蘇聯(lián)經(jīng)驗,加強司法工
[Abstract]:After the founding of New China, criminal law legislation has experienced a variety of forms of development. There is a lack of attention to the knowledge paths that these forms depend on. This paper talks about personal views and expects to sum up some valuable views on the future legislative form. First, the most important historical event of the founding of New China as a tool of revolution and struggle was to abandon the six laws of the Kuomintang period, thus objectively forming an impossible situation. New China has neither the capacity nor the necessary conditions to formulate a criminal code. However, under the circumstances of the time, the country was still facing the threat of American aggression, and the remnants of the Kuomintang were still on the move. As a result, many people realized that they had to learn from the Soviet experience and strengthen the judiciary.
