【摘要】：利用偽基站犯罪是近年來產(chǎn)生的新型犯罪,是圍繞偽基站設(shè)備為犯罪對象或者犯罪工具的一系列犯罪,該類犯罪不僅破壞正常的通信秩序,影響運營商正常的經(jīng)營活動,擾亂市場秩序,而且危害公共安全、侵犯公民隱私權(quán),嚴(yán)重影響用戶手機使用,損害公民財產(chǎn)權(quán)益,甚至威脅到國家安全,社會危害性極其嚴(yán)重。也正是因為如此,在學(xué)術(shù)界中,關(guān)于利用偽基站犯罪侵犯的法益以及處理方式引起較大爭議;在司法實踐中,對此類犯罪的定性不一,同案不同判的現(xiàn)象突出。本文的研究包括三部分的內(nèi)容:首先從利用偽基站犯罪的概念和現(xiàn)狀入手,明確該類犯罪的現(xiàn)狀和特征,整合利用偽基站犯罪的法律規(guī)制現(xiàn)狀,從整體上把握這一犯罪的概況,為利用偽基站犯罪定性分析提供思路;其次從犯罪論的角度對利用偽基站犯罪的構(gòu)成要件、種類、此罪與彼罪進(jìn)行分析,明確利用偽基站犯罪侵害的法益以及觸犯的刑法條文,以期闡明利用偽基站犯罪的定性問題,為司法實踐定罪提供理論參考;再者,對利用偽基站犯罪的共犯認(rèn)定和罪數(shù)形態(tài)進(jìn)行分析,目的在于解決利用偽基站犯罪案件中的共犯、罪數(shù)形態(tài)問題。綜合全文來看,利用偽基站犯罪類案件形式多樣,涉及面廣,犯罪成本較低,并逐漸向團(tuán)體化、產(chǎn)業(yè)化、精準(zhǔn)化發(fā)展,對社會的危害性不斷加大。筆者通過搜集各省、市辦理偽基站的典型案例,并結(jié)合各界學(xué)者觀點,最終提出一個相對比較全面的定性思路,其目的是為了解決存在于司法實踐中非法生產(chǎn)、銷售、使用偽基站案件定性及適用刑罰不準(zhǔn)確、不統(tǒng)一的問題,希望更好的指導(dǎo)司法實踐,為利用偽基站犯罪的刑法規(guī)制貢獻(xiàn)綿薄之力。
[Abstract]:The crime of using pseudo-base station is a new type of crime in recent years. It is a series of crimes that revolve around the equipment of pseudo-base station as the object or instrument of crime. This kind of crime not only destroys the normal communication order, but also affects the normal business activities of operators. Disturbing the market order, harming public safety, infringing citizens' privacy, seriously affecting the use of mobile phones, harming citizens' property rights and interests, and even threatening national security, the social harm is extremely serious. Because of this, in the academic circles, the law interests and the way to deal with the crime of using pseudo-base station crime cause great controversy; in judicial practice, the qualitative nature of this kind of crime is different, and the phenomenon of different judgments of the same case is prominent. The research of this paper includes three parts: firstly, starting with the concept and present situation of using pseudo-base station crime, this paper clarifies the present situation and characteristics of this kind of crime, integrates the present situation of legal regulation of using pseudo-base station crime, and grasps the general situation of this crime from the whole. In order to make use of the qualitative analysis of the crime of pseudo-base station, secondly, from the angle of crime theory, to analyze the constituent elements, types, this crime and that crime of using the pseudo-base station crime, and to make clear the legal interest and the criminal law provisions of crime infringement by using the pseudo-base station crime. In order to clarify the qualitative problem of using pseudo-base station crime, to provide a theoretical reference for judicial practice conviction; moreover, to analyze the pattern of accomplice and number of crimes committed by using pseudo-base station crime, in order to solve the problem of accomplice in crime cases of using pseudo-base station. The problem of the form of the number of crimes. Comprehensive full text view, the use of pseudo-base station crime cases in a variety of forms, involving a wide range, low cost of crime, and gradually to group, industrialization, precision development, the harm to society is increasing. By collecting the typical cases of pseudo-base stations handled by provinces and cities, and combining the views of scholars from all walks of life, the author finally puts forward a relatively comprehensive qualitative thinking, the purpose of which is to solve the problem of illegal production and sale in judicial practice. The use of pseudo-base station cases and the application of inaccurate and inconsistent penalties, in the hope of better guidance of judicial practice, for the use of pseudo-base station crime criminal law regulation contribution.
