【摘要】：有組織犯罪是一種危害極其嚴(yán)重的犯罪形態(tài),與恐怖主義犯罪、毒品犯罪一起被聯(lián)合國(guó)列為當(dāng)今人類三大災(zāi)難性犯罪。有組織犯罪具有“反社會(huì)性”,其犯罪行為具有暴力性,對(duì)政治、經(jīng)濟(jì)領(lǐng)域具有極強(qiáng)的滲透性和侵蝕性,威脅著整個(gè)國(guó)際社會(huì)的合法秩序。 國(guó)際刑法學(xué)界對(duì)有組織犯罪的研究已經(jīng)處于成熟階段,我國(guó)理論界對(duì)有組織犯罪的研究也取得了豐碩的成果,但其間還存在著較多問(wèn)題。在全球化和網(wǎng)絡(luò)化背景下,有組織犯罪表現(xiàn)出與以往不同的形式特征,值得我們關(guān)注和研究。本文選取有組織犯罪的“組織性”特征作為研究對(duì)象,從有組織犯罪集團(tuán)的組織形式和組織結(jié)構(gòu)角度剖析有組織犯罪的新趨勢(shì)。 文章分為引言、正文和結(jié)語(yǔ)三大部分,其中正文包括四小部分。 在引言中,介紹了選題的意義和研究有組織犯罪組織性的必要性；從整體上介紹了學(xué)術(shù)界對(duì)于有組織犯罪的研究成果。正文第一部分探討了有組織犯罪的概念,從國(guó)外和國(guó)內(nèi)兩個(gè)方面闡述了刑法學(xué)界關(guān)于有組織犯罪概念的研究成果、分歧和問(wèn)題。分析了我國(guó)關(guān)于有組織犯罪概念的研究及其不足之處。對(duì)有組織犯罪組織性進(jìn)行了界定。第二部分探討了有組織犯罪的演變特征,從組織結(jié)構(gòu)和基本形態(tài)兩方面分析了其演變特征,認(rèn)為有組織犯罪是一個(gè)變化發(fā)展的過(guò)程。第三部分從組織的外部形態(tài)和內(nèi)部結(jié)構(gòu)兩個(gè)方面分析了有組織犯罪組織性的特征文章第四部分,分析了有組織犯罪組織性的新趨勢(shì),認(rèn)為有組織犯罪集團(tuán)為了增加隱蔽性,將更多采用網(wǎng)絡(luò)化的組織結(jié)構(gòu),并且正在向網(wǎng)絡(luò)社會(huì)蔓延,或?qū)⒊霈F(xiàn)網(wǎng)絡(luò)有組織犯罪。第五部分針對(duì)上述分析提出了防治有組織犯罪的對(duì)策,對(duì)完善我國(guó)有組織犯罪的立法體系提出了一些建議和構(gòu)想,并提出了司法實(shí)踐中犯罪組織的一般認(rèn)定標(biāo)準(zhǔn)。在結(jié)語(yǔ)中,主要對(duì)文章研究的內(nèi)容進(jìn)行了總結(jié)和對(duì)未來(lái)展望。
[Abstract]:Organized crime is a form of crime with extremely serious harm. Together with terrorist crime and drug crime, organized crime is classified as three catastrophic crimes by the United Nations. Organized crime is anti-social, its criminal behavior is violent, and it has a strong permeability and erosion to the political and economic fields, threatening the legal order of the whole international society. The research on organized crime in the international criminal law field has been in the mature stage, and the research on organized crime in our country has also made great achievements, but there are still many problems. In the context of globalization and networking, organized crime shows different formal characteristics from the past, which deserves our attention and research. In this paper, the "organized" characteristics of organized crime are selected as the research object, and the new trend of organized crime is analyzed from the perspective of the organizational form and organizational structure of organized criminal groups. The article is divided into three parts: introduction, text and conclusion, in which the text consists of four small parts. In the introduction, it introduces the significance of choosing the topic and the necessity of studying the organized crime, and introduces the research results of the organized crime in the academic circles as a whole. The first part of the text discusses the concept of organized crime, from the two aspects of foreign and domestic criminal law on the concept of organized crime research results, differences and problems. This paper analyzes the research on the concept of organized crime in China and its inadequacies. The organized nature of organized crime is defined. The second part discusses the evolution characteristics of organized crime, analyzes its evolution characteristics from the two aspects of organizational structure and basic form, and holds that organized crime is a process of change and development. The third part analyzes the characteristics of organized crime from two aspects of the external form and internal structure of the organization. The fourth part analyzes the new trend of the organized crime, and thinks that the organized criminal group is in order to increase the concealment. More networked organizational structures will be adopted and are spreading to the cyber society, or cyber organized crime will occur. The fifth part puts forward the countermeasures to prevent and cure organized crime, puts forward some suggestions and ideas to perfect the legislative system of organized crime in our country, and puts forward the general recognition standard of criminal organization in judicial practice. In the conclusion, it summarizes the content of the article and looks forward to the future.
