【摘要】：由于故意殺人罪的罪狀表述相對(duì)簡(jiǎn)單、刑罰幅度的設(shè)置又比較寬泛,導(dǎo)致故意殺人罪的死刑適用在司法實(shí)踐中存在量刑失衡等突出問(wèn)題,不利于實(shí)現(xiàn)司法公正。本文重點(diǎn)介紹了各種情節(jié)在故意殺人罪死刑案件中的地位和作用,包括法定情節(jié)和酌定情節(jié),并選取其中有代表性的部分進(jìn)行詳細(xì)分析。聯(lián)系故意殺人案件的特征,應(yīng)當(dāng)對(duì)不同的量刑情節(jié)進(jìn)行梳理,并結(jié)合當(dāng)前限制死刑適用的趨勢(shì)和少殺、慎殺的政策,以達(dá)到精確量刑的目標(biāo),實(shí)現(xiàn)刑法的謙抑性原則。本文分為三個(gè)部分。第一部分論證法定情節(jié)在故意殺人死刑案件中的適用,包括累犯、共同犯罪、自首和立功情節(jié)。第二部分主要分析了酌定情節(jié)在故意殺人罪死刑案件中的適用。第三部分指出了量刑情節(jié)在故意殺人罪的死刑案件的適用過(guò)程中存在的不足并對(duì)其完善提出自己的想法。
[Abstract]:Due to the relatively simple description of the crime of intentional homicide and the wide range of punishment, the death penalty of intentional homicide has some outstanding problems, such as the imbalance of sentencing in judicial practice, which is not conducive to the realization of judicial justice. This paper focuses on the status and role of various circumstances in the death penalty cases of intentional homicide, including the statutory circumstances and discretionary circumstances, and select the representative part of the case for detailed analysis. According to the characteristics of intentional homicide cases, different circumstances of sentencing should be combed, and combined with the current trend of restricting the application of the death penalty and the policy of less killing and careful killing, in order to achieve the goal of accurate sentencing and realize the principle of modesty in criminal law. This paper is divided into three parts. The first part demonstrates the application of legal circumstances in death penalty cases, including recidivism, joint crime, surrender and meritorious service. The second part mainly analyzes the application of discretionary circumstances in death penalty cases of intentional homicide. The third part points out the shortcomings of sentencing circumstances in the death penalty cases of intentional homicide and puts forward his own ideas for its perfection.
