【摘要】：正刑罰是古代法律制度的重要構(gòu)成內(nèi)容,其發(fā)展與演變實質(zhì)上也反映了中國社會的發(fā)展與進(jìn)步。刑罰發(fā)展與變化的原因與表現(xiàn)都是多層次的,但是整體趨勢是從原始的野蠻、落后、殘暴向著文明、慎刑方向發(fā)展�！稘h唐刑罰演變特點研究》一書運用了對比研究的方式,將漢代與唐代的刑罰作為研究對象,對漢代與唐代的死刑、流刑、勞役刑、身體刑等
[Abstract]:Positive penalty is an important component of ancient legal system, and its development and evolution reflect the development and progress of Chinese society. The causes and manifestations of penalty development and change are multi-level, but the overall trend is from primitive barbarism, backwardness, cruelty to civilization and careful punishment. Taking the penalty of Han Dynasty and Tang Dynasty as the object of study, the death penalty, flow penalty, servitude penalty, body punishment and so on in the Han Dynasty and the Tang Dynasty are studied.
