【摘要】：在審判中,隱性因素如同"無(wú)形之手"助推案件事實(shí)認(rèn)定與法律適用,司法潛見(jiàn)、邏輯推理、事實(shí)取舍、證據(jù)采信、經(jīng)驗(yàn)判斷、權(quán)力滲透等等,是隱性因素的表現(xiàn)形態(tài)。在死刑適用過(guò)程中,隱性因素是客觀存在的,是在顯性的死刑判決書(shū)中未載明也無(wú)法載明,是死刑適用方式運(yùn)行的"暗線",決定、影響法官適用死刑適用的隱性因素主要是案件社會(huì)結(jié)構(gòu)、媒體輿論的報(bào)道關(guān)注和信訪。在死刑適用過(guò)程中,隱性權(quán)力、案件社會(huì)結(jié)構(gòu)、法官個(gè)人認(rèn)知之間相互嵌入,而且這些因素之間是相互依賴、相互強(qiáng)化,各"權(quán)力擁有者"借助"領(lǐng)導(dǎo)、監(jiān)督、指導(dǎo)"等正當(dāng)事由,充分發(fā)揮其影響力;當(dāng)事人及利益相關(guān)者借助新聞媒體、信訪等因素撬動(dòng)隱性權(quán)力,并以此實(shí)現(xiàn)自己訴求。
[Abstract]:In the trial, the hidden factors, such as "invisible hand" to promote the case facts and the application of law, judicial latent opinion, logical reasoning, fact selection, evidence acceptance, empirical judgment, power penetration and so on, are the manifestation of hidden factors. In the process of application of the death penalty, the hidden factors exist objectively and can not be stated either in the explicit judgment of death penalty, and are the "dark lines" of the operation of the mode of application of the death penalty. The hidden factors affecting the application of the death penalty are the social structure of the case, the attention of the media and the letters and visits. In the application of the death penalty, the implicit power, the social structure of the case and the individual cognition of the judge are embedded in each other, and these factors are interdependent and mutually reinforcing. "guiding" and other legitimate reasons, fully exerting its influence; the parties and stakeholders leverage the hidden power with the help of news media, letters and visits, and realize their own demands.
