【摘要】：近年來(lái),隨著警察行政執(zhí)法制度的改革與發(fā)展。警察執(zhí)法、警察權(quán)益、以及警民紛爭(zhēng)等問(wèn)題已經(jīng)成為社會(huì)關(guān)注的焦點(diǎn)。在我們社會(huì)主義法治國(guó)家,法律就是要保障國(guó)家和人民的利益不受侵犯。對(duì)于警察來(lái)說(shuō),在執(zhí)法的過(guò)程中切實(shí)保障自己的合法權(quán)益不受侵害是十分重要的。然而,在我們的現(xiàn)實(shí)生活中,一線警察在執(zhí)行公務(wù)時(shí)受阻、受擾、受侵害甚至因公獲刑的案例屢見(jiàn)不鮮,這嚴(yán)重影響了警察工作的積極性,為警察在以后的執(zhí)法過(guò)程中造成了巨大的壓力。因此,切實(shí)加強(qiáng)對(duì)公安一線民警權(quán)益的保護(hù)成為了當(dāng)前警界的強(qiáng)烈呼聲�，F(xiàn)本文由陳豫淮,汪智萍,謝抒婉參與項(xiàng)目研究,盧延旭老師指導(dǎo)下將從近期發(fā)生的慶安事件出發(fā),分析公安一線執(zhí)法者面對(duì)暴力抗法者該怎樣采取措施應(yīng)對(duì),從保護(hù)警察執(zhí)行公務(wù)的視角來(lái)談警察如何運(yùn)用法律進(jìn)行自我保護(hù)。
[Abstract]:In recent years, with the reform and development of police administrative law enforcement system. Police law enforcement, police rights and interests, as well as police disputes and other issues have become the focus of attention. In our socialist country ruled by law, the law is to protect the interests of the state and the people from infringement. It is very important for the police to protect their legitimate rights and interests in the process of law enforcement. However, in our real life, the front-line police are blocked, harassed, infringed and even sentenced on duty in the course of their official duties, which seriously affects the enthusiasm of the police. For the police in the subsequent law enforcement process caused great pressure. Therefore, strengthening the protection of the rights and interests of the police has become a strong voice in the police field. In this paper, Chen Yu-huai, Wang Zhiping, Xie Li-wan participated in the project research. Under the guidance of teacher Lu Yanxu, we will start from the recent Qingan incident and analyze how the police front-line law enforcers should take measures to deal with the violent resistance to the law. From the perspective of protecting the police from their official duties, this paper discusses how the police use the law to protect themselves.
