【摘要】：刑法公眾認(rèn)同,是指刑法實踐包括刑法立法、刑法司法乃至刑罰執(zhí)行因內(nèi)化和體現(xiàn)社會公眾普遍認(rèn)同的常識、常理和常情而被社會公眾普遍認(rèn)可、信賴與體行。心理學(xué)中的心理共振原理印證著刑法公眾認(rèn)同的概念,三元交互理論體現(xiàn)著刑法公眾認(rèn)同的心理結(jié)構(gòu),而心理控制源理論說明著刑法公眾認(rèn)同具有增強(qiáng)個體認(rèn)知能力和行為動力、改善個體情感狀態(tài),從而有利于保障人權(quán)和穩(wěn)定社會秩序的重要意義。
[Abstract]:The public identification of Criminal Law refers to the practice of criminal law including the legislation of criminal law, the common sense of the criminal law judicature and the execution of the penalty, and the common sense of the public. It is universally recognized by the public, trust and practice by the public. The principle of psychological resonance in psychology confirms the concept of the public identification of the criminal law, and the three yuan interaction theory embodies the theory of the criminal law. The psychological structure of the public identification of criminal law, and the theory of psychological control sources shows that the public identification of criminal law has the important significance of enhancing the individual cognition and behavior power, improving the individual emotional state, and thus protecting human rights and stabilizing the social order.
