【摘要】："依推定的權(quán)利人同意之行為"是指:與權(quán)利人在所涉事項的范圍內(nèi)具有一定關(guān)系的行為人,因無法明確知悉權(quán)利人的現(xiàn)實意志,而通過考察自身與權(quán)利人的特定關(guān)系,尤其是相互間的交往過程和客觀存在的情勢,以權(quán)利人的行為傾向為導(dǎo)向處置原本應(yīng)由權(quán)利人自身處置事項的行為。行為人既可以為權(quán)利人的利益而進行推定,也可以為自己或第三人的利益而推定。在判斷推定內(nèi)容是合理時,不僅要考慮權(quán)利人的事后態(tài)度,更重要的是考慮雙方因相互"特定關(guān)系"而建立的規(guī)范。一方面這類規(guī)范不能以不可容忍的方式危害社會,另一方面,其必須為行為人與權(quán)利人的交往劃定界限,而非單純地維護哪一方的法益。
[Abstract]:"the act of consent of the presumed right holder" refers to: the actor who has a certain relationship with the right holder within the scope of the matter involved, because he cannot clearly know the real will of the right holder, and by examining the specific relationship between himself and the right holder, In particular, the process of mutual communication and the objective existence of the situation, based on the behavior of the obligee as a guide to deal with the behavior should be handled by the obligee himself. The actor can infer not only for the benefit of the obligee, but also for the benefit of himself or the third party. When judging that the content of presumption is reasonable, we should not only consider the right holder's attitude after the event, but also consider the norms established by both sides because of each other's "specific relationship". On the one hand, this kind of norm can't harm society in an intolerable way, on the other hand, it must delimit the boundary for the communication between the actor and the obligee, rather than simply defending the legal interests of which side.
