【摘要】：刑法謙抑觀作為刑法理念的重要組成部分,對于解釋刑法、適用刑法起著重要的指導作用。在信息網絡高度發(fā)展的當今,侵犯網絡虛擬財產的現象屢見不鮮,與傳統(tǒng)刑法謙抑觀之間的矛盾沖突加劇。對此,刑法謙抑觀的內涵應保持與時俱進的品格,一方面允許刑法犯罪圈的適度擴張,另一方面也要避免刑法的矯枉過正;通過對刑法財產犯罪中“財物”一詞擴大解釋,使得侵犯虛擬財產的行為在刑法框架內得到妥當的處罰。
[Abstract]:As an important part of the concept of criminal law, the concept of modesty of criminal law plays an important guiding role in the interpretation of criminal law and the application of criminal law. Nowadays, with the development of information network, the phenomenon of infringing on network virtual property is common, and the contradiction and conflict between it and traditional criminal law is becoming more and more serious. In view of this, the connotation of the modest view of restraint in criminal law should maintain the character of keeping pace with the times. On the one hand, it should allow the moderate expansion of the criminal circle of crime, on the other hand, it should also avoid the overcorrection of the criminal law, and expand the interpretation of the term "property" in the crime of property in criminal law. Make the violation of virtual property in the framework of criminal law to get appropriate punishment.
