【摘要】：嚴(yán)肅查辦和預(yù)防危害生態(tài)環(huán)境背后所涉的職務(wù)犯罪、為生態(tài)文明建設(shè)提供強(qiáng)有力的司法保障,是司法機(jī)關(guān)一項(xiàng)重要而緊迫的任務(wù)。職務(wù)犯罪主要包括貪污賄賂犯罪和瀆職侵權(quán)犯罪,本研究針對林業(yè)生態(tài)環(huán)境安全領(lǐng)域職務(wù)犯罪主要是瀆職犯罪的主要類型,以及司法實(shí)踐中存在的環(huán)境保護(hù)領(lǐng)域立法和司法解釋相對較少、環(huán)境保護(hù)領(lǐng)域?yàn)^職犯罪罪名細(xì)分度較低、瀆職犯罪的立案標(biāo)準(zhǔn)存在一定的爭議等問題進(jìn)行了剖析;并梳理了相關(guān)的立法及司法解釋回應(yīng);指出懲治此類犯罪的關(guān)鍵是厘清法律規(guī)定、保證打擊犯罪指向精準(zhǔn)、掌握第一手證據(jù)材料,強(qiáng)化檢警配合、固定損失后果,強(qiáng)化執(zhí)法監(jiān)督制約,注重法律效果與社會效果的有機(jī)統(tǒng)一等。
[Abstract]:It is an important and urgent task for the judicial organs to investigate and prevent the job-related crimes behind the ecological environment and to provide a strong judicial guarantee for the construction of ecological civilization. Duty crime mainly includes embezzlement and bribery crime and malfeasance infringement crime. In this study, duty crime in the field of forestry ecological environment security is the main type of dereliction of duty crime. There are few legislative and judicial explanations in the field of environmental protection in judicial practice, the subdivision of dereliction of duty crime in the field of environmental protection is relatively low, and there are some disputes in filing standards of dereliction of duty crime. And combed the relevant legislative and judicial interpretation responses; pointed out that the key to punish such crimes is to clarify the legal provisions, to ensure that the target of the crackdown is accurate, to grasp first-hand evidence materials, to strengthen the cooperation of prosecutors and police, and to fix the consequences of loss. Strengthen the supervision and restriction of law enforcement, pay attention to the organic unity of legal effect and social effect, etc.
