【摘要】：刑法體系解釋方法,在法解釋學(xué)中起著重要的作用,是其中重要的一種解釋方法。體系解釋可以避免斷章取義,孤立的理解條文。刑法體系解釋要求解釋某一具體的法律文本時,應(yīng)將其放置于整個法律體系涵攝范圍內(nèi),觀察和分析其具體適用途徑,以便更好的解釋適用刑法的條文規(guī)定。本文除引言外,由五個部分組成,具體內(nèi)容如下：第一部分是問題的提出。這一部分主要通過案例南京“換偶”案、上海酒托案、山東葛某交通肇事案,引出刑法體系解釋方法,從系統(tǒng)整體的視角出發(fā),闡述南京“換偶”案中對聚眾淫亂罪與公序良俗的矛盾沖突解釋,上海酒托案中涉及強(qiáng)迫交易與詐騙罪最終定性解釋,以及對于交通肇事罪中是否包含故意主觀因素解釋,借此證成刑法體系解釋的功效。第二部分是刑法體系解釋的基本內(nèi)涵。這一部分主要厘清刑法體系解釋的基本內(nèi)涵、闡述其意義、范圍和刑法體系解釋與其他刑法解釋方法,把握好他們之間的聯(lián)系和區(qū)別,以便更好理解刑法體系解釋,有助于刑法體系解釋的適用。第三部分是刑法體系解釋之適用。一方面闡述刑法體系解釋的適用規(guī)則,即同一律規(guī)則、同項(xiàng)性規(guī)則、同類性規(guī)則和排他性規(guī)則,另一方面,回歸具體的案例實(shí)踐,分析上述三則案例中分別體現(xiàn)具體刑法體系解釋的適用規(guī)則,結(jié)合其它方面并予以分析闡述刑法體系解釋。第四部分是刑法體系解釋適用功能的理論發(fā)現(xiàn)。這一部分主要以正義理念為指導(dǎo)；以合理性為前提；以罪刑法定為準(zhǔn)則；注重刑法用語的相對性,從刑法適用理論上探究刑法體系解釋的具體適用功能。第五部分是刑法體系解釋適用功能的實(shí)踐完善。這一部分主要從社會實(shí)踐角度探究刑法體系解釋適用功能,刑法體系解釋法律體系自身局限性制約體系解釋完善；體系解釋對刑事政策的介入適用；體系解釋與判例指導(dǎo)之適用；體系解釋與其他解釋方法的位階,借此更加完善刑法體系解釋的適用實(shí)踐功能。
[Abstract]:The interpretation method of criminal law system plays an important role in legal hermeneutics. The interpretation of the system can avoid taking out of context and understanding the text in isolation. When the interpretation of criminal law system requires the interpretation of a specific legal text, it should be placed within the scope of the whole legal system to observe and analyze its specific ways of application in order to better interpret the provisions of the applicable criminal law. In addition to the introduction, this paper consists of five parts, the specific contents are as follows: the first part is the question. This part mainly through the case of Nanjing "exchange couple" case, Shanghai Jiutuo case, Shandong Gemou traffic accident case, led to the criminal law system interpretation method, from the system as a whole perspective, This paper expounds the contradiction and conflict between the crime of mass fornication and public order and good custom in the case of "changing couple" in Nanjing, the final qualitative explanation of the crime of forced transaction and fraud involved in the case of Shanghai Jiutuo, and the explanation of whether the traffic accident crime contains intentional subjective factors. By this evidence into the interpretation of the criminal law system effect. The second part is the basic connotation of the interpretation of criminal law system. This part mainly clarifies the basic connotation of the interpretation of the criminal law system, expounds its meaning, scope and interpretation of the criminal law system and other interpretation methods of criminal law, and grasps the connection and difference between them, so as to better understand the interpretation of the criminal law system. It is helpful to the application of the interpretation of criminal law system. The third part is the application of criminal law system interpretation. On the one hand, it expounds the applicable rules of the interpretation of criminal law system, that is, the same uniform rule, the same item rule, the similar rule and the exclusive rule, on the other hand, it returns to the concrete case practice. This paper analyzes the applicable rules of the interpretation of the specific criminal law system in the above three cases, and expounds the interpretation of the criminal law system in combination with other aspects. The fourth part is the theoretical discovery of the function of interpretation and application of criminal law system. This part is mainly guided by the concept of justice; based on rationality; on the basis of crime and criminal law as the criterion; pays attention to the relativity of criminal law terms; explores the specific function of the interpretation of criminal law system from the theory of criminal law application. The fifth part is the practice perfection of the function of interpretation and application of criminal law system. This part mainly explores the function of interpretation and application of criminal law system from the angle of social practice, the limitation of system interpretation of criminal law system, the perfection of system interpretation, the intervention of system interpretation to criminal policy, and the application of system interpretation to criminal policy. The application of system interpretation and case guidance, the rank of system interpretation and other interpretation methods, so as to perfect the applicable practice function of criminal law system interpretation.
