【摘要】：對商業(yè)秘密進(jìn)行刑事立法保護(hù)具有相應(yīng)的正當(dāng)性與必要性。我國在刑法中明確規(guī)定了侵犯商業(yè)秘密罪對商業(yè)秘密進(jìn)行保護(hù),對維護(hù)良好的經(jīng)濟(jì)秩序起到了一定的法律保障作用。但是,由于我國相應(yīng)立法較為粗糙,這種粗放型立法模式并不能使司法實踐周全運(yùn)行。因此,我們有必要進(jìn)一步探討完善我國商業(yè)秘密的刑事保護(hù)立法問題。本文擬從我國現(xiàn)行商業(yè)秘密保護(hù)的刑事立法出發(fā),結(jié)合相關(guān)司法實踐現(xiàn)狀中出現(xiàn)的問題(以筆者所在C市近五年侵犯商業(yè)秘密刑事案件為樣本),分析我國現(xiàn)行商業(yè)秘密刑事保護(hù)立法上所存在的罪名設(shè)定,入罪主觀情節(jié)、刑罰配置、量刑條件等問題,并提出相應(yīng)立法完善建議。全文除引言和結(jié)語外共分為四個部分：第一部分為我國商業(yè)秘密刑事立法概述。簡要介紹我國商業(yè)秘密刑事保護(hù)立法的歷史沿革以及現(xiàn)行立法,同時總結(jié)現(xiàn)行立法特征。第二部分為商業(yè)秘密刑事保護(hù)司法實踐現(xiàn)狀。筆者以C市近五年侵犯商業(yè)秘密刑事案件為樣本,對其進(jìn)行分析,得出我國現(xiàn)行商業(yè)秘密刑事保護(hù)司法實踐特征。第三部分為我國現(xiàn)行立法存在的問題。結(jié)合我國的相關(guān)司法實踐現(xiàn)狀特征,對我國商業(yè)秘密刑事保護(hù)立法中存在的幾個問題進(jìn)行分析。第四部分為立法建議。根據(jù)第三部分的問題分析,對我國商業(yè)秘密刑事保護(hù)立法在罪名設(shè)置、主觀入罪條件、量刑情節(jié)、刑罰配置四個方面所存在問題提出完善建議。
[Abstract]:It is proper and necessary to protect commercial secrets by criminal legislation. The crime of infringing trade secrets is clearly stipulated in our criminal law to protect trade secrets, which plays a legal role in maintaining good economic order. However, due to the rough legislation in our country, this extensive legislative model can not make the judicial practice run completely. Therefore, it is necessary for us to further explore and perfect the criminal protection legislation of trade secrets in our country. This paper intends to proceed from the current criminal legislation for the protection of commercial secrets in China. Combining with the problems in the current situation of the relevant judicial practice (taking the criminal cases of infringing trade secrets in the last five years in C city as the sample, the author analyzes the crime setting and the subjective circumstances of the crime in the current legislation of the criminal protection of trade secrets in our country. Penalty allocation, sentencing conditions and other issues, and put forward corresponding legislative suggestions. In addition to the introduction and conclusion, the full text is divided into four parts: the first part is an overview of China's commercial secret criminal legislation. This paper briefly introduces the history and the current legislation of the criminal protection of trade secrets in China, and summarizes the characteristics of the current legislation at the same time. The second part is the current situation of criminal protection of trade secrets. The author takes the criminal cases of infringing on trade secrets in C city in recent five years as the sample, analyzes them, and obtains the characteristics of judicial practice of criminal protection of trade secrets in our country. The third part is the existing problems of our current legislation. Combined with the characteristics of the relevant judicial practice in our country, this paper analyzes several problems existing in the legislation of criminal protection of trade secrets in our country. The fourth part is legislative suggestion. According to the analysis of the problems in the third part, the author puts forward some suggestions on the problems existing in the criminal protection legislation of China's trade secrets in four aspects: the setting of the charge, the subjective incrimination condition, the circumstances of sentencing and the disposition of the penalty.
