【摘要】：在我國,由于經(jīng)濟(jì)刑法規(guī)范缺失,形成刑法系統(tǒng)和經(jīng)濟(jì)法治體系兩豁口,致使治罪效果不大理想,直接影響經(jīng)濟(jì)發(fā)展和社會(huì)建設(shè)。需要在法治之下作進(jìn)一步的科學(xué)探求和實(shí)證,以糾偏去錯(cuò)、去偽存真,支持經(jīng)濟(jì)刑法創(chuàng)立。做好經(jīng)濟(jì)刑法理論研究,著重挖掘經(jīng)濟(jì)犯罪不同于一般刑事犯罪的特性,探求建立在這種特性基礎(chǔ)上的經(jīng)濟(jì)刑法規(guī)范,從而建立經(jīng)濟(jì)刑法科學(xué):即以經(jīng)濟(jì)刑法為研究對(duì)象,闡明危害市場(chǎng)經(jīng)濟(jì)行為的犯罪與其經(jīng)濟(jì)刑事責(zé)任和經(jīng)濟(jì)刑罰之間的關(guān)系及其規(guī)律,并總結(jié)立法司法有益經(jīng)驗(yàn),又顧及有關(guān)訴訟、治罪對(duì)策和各國經(jīng)濟(jì)刑法比較等而有所創(chuàng)新和發(fā)展的科學(xué)。經(jīng)濟(jì)刑法是涉及多學(xué)科領(lǐng)域的跨學(xué)科研究,其結(jié)果會(huì)形成一部系統(tǒng)、貼實(shí)、針對(duì)性很強(qiáng)的專門規(guī)范經(jīng)濟(jì)犯罪的單行刑事法律。該法律性質(zhì)是一種新形式的特別刑法。

Economic criminal law is an interdisciplinary study involving multi-disciplinary fields, and its result will form a systematic, solid and highly targeted criminal law that specifically regulates economic crimes. This legal nature is a new form of special criminal law.
