【摘要】：刑法的規(guī)范確證機(jī)能,也就是傳統(tǒng)理論當(dāng)中的"規(guī)制機(jī)能",對(duì)于人權(quán)保障和法益保護(hù)而言,具有前提性意義。將規(guī)范確證機(jī)能作為當(dāng)下我國(guó)刑法的首要社會(huì)機(jī)能,不僅具有歷史合理性,也具有合時(shí)代性。強(qiáng)調(diào)并實(shí)現(xiàn)"法公正"是確證機(jī)能實(shí)現(xiàn)的保障條件,同時(shí)應(yīng)當(dāng)避免規(guī)范宣吁不當(dāng)、規(guī)整手段選擇不當(dāng)和刑法適用異化等問(wèn)題,以保證刑法的運(yùn)行能夠在引導(dǎo)守法意識(shí)的內(nèi)生性養(yǎng)成方面發(fā)揮有效的作用。
[Abstract]:The normative confirmation function of criminal law, which is the "regulation function" in the traditional theory, has the presupposition significance for the protection of human rights and the protection of legal interests.As the primary social function of the present criminal law of our country, the normative confirmation function is not only historical rationality, but also concomitant with the times.It is emphasized and realized that "justice of law" is the guarantee condition for confirming the realization of function, and at the same time, problems such as improper regulation of publicity, improper choice of regular means and alienation of application of criminal law should be avoided.In order to ensure the operation of criminal law can play an effective role in guiding the endogenous cultivation of law-abiding consciousness.
