基礎(chǔ)教育領(lǐng)域職務(wù)犯罪的預(yù)防與懲治——以天水市為例的實(shí)證分析

【摘要】:隨著"科教興國(guó)"戰(zhàn)略的實(shí)施,國(guó)家不斷加大對(duì)基礎(chǔ)教育的投入力度,并出臺(tái)了一系列教育惠民政策,但在教育惠民政策的實(shí)施過(guò)程中,一些中小學(xué)校長(zhǎng)、財(cái)務(wù)人員以及教育行政管理人員利用職務(wù)上的便利套取、截留、侵吞教育補(bǔ)貼款或經(jīng)費(fèi),或非法收受(索要)回扣、好處費(fèi)等。出現(xiàn)這些現(xiàn)象,既有財(cái)務(wù)管理制度不健全、監(jiān)督機(jī)制不完善、教師待遇偏低、打擊不力等客觀原因,也有"金錢(qián)至上"心理、法制意識(shí)淡薄、心存僥幸等主觀原因。為此,需要嚴(yán)格堅(jiān)持"標(biāo)本并治"的原則,既要加強(qiáng)法制教育、健全相關(guān)制度,從根源上減少該類犯罪,又要嚴(yán)格加大對(duì)該類犯罪的懲治力度。
[Abstract]:With the implementation of the strategy of "rejuvenating the country through science and education", the state has continuously increased its investment in basic education, and has issued a series of policies for the benefit of the people through education. However, in the process of implementing the policy, some principals of primary and secondary schools,Financial personnel and educational administrators take advantage of their duties to obtain, withhold, misappropriate educational subsidies or funds, or illegally accept (demand) rebates, benefits, etc.These phenomena include the imperfection of the financial management system, the imperfect supervision mechanism, the low treatment of teachers and the weak fight against them, as well as the subjective reasons, such as "money first" psychology, weak legal consciousness, and so on.Therefore, it is necessary to strictly adhere to the principle of "specimen and cure". It is necessary to strengthen the education of legal system, perfect the relevant system, reduce this kind of crime from the root cause, and strictly increase the punishment of this kind of crime.
