【摘要】：職務(wù)犯罪中瀆職犯罪與賄賂犯罪相交織與偵查權(quán)"以罪名配置"的矛盾、職務(wù)犯罪主體群體化特征凸顯與辦案力量分散的矛盾、職務(wù)犯罪行業(yè)性特征突出與偵查權(quán)"非專業(yè)分類"的矛盾,迫使偵查權(quán)內(nèi)部配置機(jī)制改革需要進(jìn)一步深化。整合調(diào)整偵查權(quán)配置與運(yùn)行機(jī)制,破解職務(wù)犯罪發(fā)展態(tài)勢(shì)與偵查權(quán)配置之間的矛盾,有利于偵查基礎(chǔ)情報(bào)信息的整合與利用,有利于線索的研判和把握,有利于偵查專業(yè)化水平的提升。因此,需要調(diào)整以罪名作為偵查權(quán)內(nèi)部劃分標(biāo)準(zhǔn)的做法,實(shí)行機(jī)構(gòu)整合,內(nèi)部按照案發(fā)領(lǐng)域的相似性進(jìn)行職能劃分,并著力深化偵查一體化機(jī)制。
[Abstract]:The contradiction between dereliction of duty crime and bribery crime is intertwined with investigation power "collocation by charge", and the contradiction between the collectivization of the subject of duty crime and the scattered power of handling cases is highlighted.The contradiction between the professional characteristics of job-related crimes and the "non-professional classification" of investigation power forces the reform of the internal allocation mechanism of investigation power to be further deepened.Integrating and adjusting the allocation and operation mechanism of investigation power, solving the contradiction between the development situation of duty crime and the allocation of investigation power, is beneficial to the integration and utilization of the basic intelligence information of investigation, and to the study and grasp of clues.It is propitious to improve the level of investigation specialization.Therefore, it is necessary to adjust the method of taking the crime as the standard of internal division of investigation power, to carry out the organizational integration, to divide the internal functions according to the similarity in the field of crime occurrence, and to deepen the mechanism of investigation integration.
