【摘要】：在濫用銀行卡犯罪的刑法適用上,必須梳理銀行卡法律關(guān)系中的刑法要素,并明確相似罪名的界限。在存款的占有判斷中,刑法應(yīng)以行為人對他人錢款的控制關(guān)系為標(biāo)準(zhǔn);根據(jù)法律擬制的立法技術(shù),ATM機可以構(gòu)成詐騙類犯罪的對象;在特約商戶和持卡人共謀惡意透支時,其業(yè)務(wù)已脫離"中立行為"的范疇,而構(gòu)成可罰的共犯行為。在濫用本人銀行卡中,利用柜員機故障惡意取款的,應(yīng)構(gòu)成侵占罪;存入假幣換取真幣的,或者擅自掛失提取本人銀行卡中他人錢款的,應(yīng)構(gòu)成詐騙罪。在濫用他人銀行卡中,撿拾他人銀行卡并使用的,構(gòu)成信用卡詐騙罪;利用他人遺忘在ATM機中銀行卡取款的,構(gòu)成盜竊罪;詐騙銀行卡并使用的,應(yīng)根據(jù)受害人是否具有處分卡內(nèi)錢款的意思,分別認(rèn)定為詐騙罪或信用卡詐騙罪。
[Abstract]:In the application of criminal law for the abuse of bank card, it is necessary to sort out the elements of criminal law in the legal relationship of bank card and clarify the limits of similar charges.Its business is out of the category of "neutral act" and constitutes a punishable accomplice.In the abuse of my bank card, maliciously withdrawing money by using a teller machine failure shall constitute a crime of embezzlement; if a counterfeit coin is deposited in exchange for real money, or if you report without authorization the withdrawal of other people's money from your bank card, it shall constitute a crime of fraud.In the misuse of other people's bank cards, picking up other people's bank cards and using them constitutes a crime of credit card fraud; using others to forget to withdraw money from a bank card in an ATM machine constitutes a crime of theft; and defrauding the bank card and using it,The victim should be identified as fraud or credit card fraud according to whether the victim has the intention to dispose of the money in the card.
