【摘要】：在互聯(lián)網(wǎng)共同犯罪中存在意思聯(lián)絡(luò)難以認(rèn)定的情況。就域外否定意思聯(lián)絡(luò)的片面共同犯罪理論而言,是否以及多大程度上承認(rèn)片面共同犯罪與區(qū)分式參加體系和統(tǒng)一正犯人體系的立法及理論選擇有關(guān)。我國(guó)采取的是"整體認(rèn)定犯罪、個(gè)別分配責(zé)任"的獨(dú)立模式,意思聯(lián)絡(luò)是不可放棄的立法立場(chǎng),對(duì)于秘密支持可以處以他人預(yù)備的刑罰。互聯(lián)網(wǎng)時(shí)代的意思聯(lián)絡(luò)具有特殊性,可以利用"針對(duì)共同性的未必故意"和"通過(guò)符號(hào)語(yǔ)言的意思聯(lián)絡(luò)"實(shí)現(xiàn)意思聯(lián)絡(luò)的緩和,并通過(guò)入罪門(mén)檻的個(gè)別考察限制處罰范圍。
[Abstract]:In Internet joint crime, there is a situation where it is difficult to identify meaning liaison.As far as the theory of unilateral joint crime with negative meaning is concerned, whether and to what extent the theory of unilateral joint crime is related to the legislative and theoretical choice of the differentiated participation system and the unified criminal system.Our country adopts the independent mode of "recognizing the crime as a whole and distributing the responsibility individually", meaning contact is the legislative stand that cannot be abandoned, and the penalty for secret support can be imposed by others.In the Internet era, the meaning liaison has its particularity. It can realize the relaxation of the meaning contact by "not intentionally aiming at the commonality" and "through the symbolic language", and limit the scope of punishment through the individual investigation of the threshold of incrimination.
