【摘要】：計(jì)劃生育是我國(guó)的基本國(guó)策，，國(guó)家對(duì)墮胎的態(tài)度一直是放任的，因此在我國(guó)大陸地區(qū)墮胎是合法的，人們對(duì)我國(guó)的墮胎問(wèn)題一直以來(lái)關(guān)注較少。但并不意味著我國(guó)所有的墮胎行為都是合法的，我國(guó)也存在非法墮胎的行為。直到近幾年由于選擇性別墮胎而引起男女性別比例失衡問(wèn)題突出，人們才開(kāi)始關(guān)注非醫(yī)學(xué)需要的選擇性別墮胎問(wèn)題，國(guó)家和各級(jí)地方政府制定了相應(yīng)的法律法規(guī)。結(jié)合我國(guó)的國(guó)情以及借鑒國(guó)外的墮胎犯罪，中國(guó)的非法墮胎行為除了選擇性別墮胎外，由于墮胎手段、主體或者時(shí)間等非法的原因，還存在其他形式的非法墮胎行為。通過(guò)考察目前的刑法規(guī)范發(fā)現(xiàn)并不能完全規(guī)范現(xiàn)有的非法墮胎行為，導(dǎo)致犯罪行為人因法律的紕漏而逃脫法律的懲罰。同時(shí)刑法理論界對(duì)非法墮胎行為的研究也相對(duì)欠缺。通過(guò)考量現(xiàn)有立法的不足，結(jié)合借鑒國(guó)外關(guān)于墮胎犯罪的立法經(jīng)驗(yàn)，因此認(rèn)為有必要通過(guò)增設(shè)非法墮胎罪來(lái)規(guī)制我國(guó)的非法墮胎行為。這樣不僅能打擊非法墮胎犯罪，維護(hù)我國(guó)的社會(huì)秩序，而且能保障孕婦的身體健康和生命安全。也能減少計(jì)劃生育工作人員亂來(lái)的行為，同時(shí)更好地實(shí)施計(jì)劃生育的基本國(guó)策。
[Abstract]:Family planning is the basic national policy of our country, and the state's attitude towards abortion has always been laissez-faire, so abortion is legal in mainland China. People have always paid less attention to abortion in our country. But it does not mean that all abortions in our country are legal. There is also illegal abortion in our country. Only in recent years did people begin to pay attention to the problem of sex-selective abortion, which has caused the imbalance between men and women due to sex-selective abortion. The state and local governments at all levels have formulated corresponding laws and regulations. In the light of China's national conditions and drawing lessons from foreign abortion crimes, China's illegal abortion behavior, in addition to the choice of sex abortion, is due to abortion methods. There are also other forms of illegal abortion due to illegal reasons such as subject or time. Through an examination of the current criminal law norms, it is found that the existing illegal abortion behavior cannot be completely regulated. At the same time, the research on illegal abortion in the criminal law theorists is also relatively lacking. By considering the shortcomings of the existing legislation, we can learn from the experience of foreign countries on abortion crime legislation. Therefore, it is necessary to regulate illegal abortion in our country by establishing the crime of illegal abortion. In this way, we can not only crack down on the crime of illegal abortion, but also maintain the social order in our country. Moreover, it can ensure the health and safety of pregnant women. It can also reduce the behavior of family planning workers, and at the same time, better implement the basic state policy of family planning.
