【摘要】：在司法實踐中,在校生非理性犯罪類案件具有案發(fā)誘因的輕微性和危害后果的嚴(yán)重性反差極大的特征。文章以2010-2014年中國裁判文書網(wǎng)我國大陸11個省市14-34歲21名在校生因生活瑣事實施非理性犯罪為樣本,研判當(dāng)前該類犯罪的現(xiàn)狀和特點(diǎn),指出涉案學(xué)生自身的性格缺陷以及低自控或低自珍的心理特征,是引發(fā)負(fù)面情緒以及犯罪行為的根本原因。在此基礎(chǔ)上,提出一方面通過提高家長的教育水平,提升家庭教育品質(zhì)使青少年增強(qiáng)與家庭的情感聯(lián)接,形成健全人格,另一方面通過學(xué)校加強(qiáng)綜合管理,尤其是強(qiáng)化大學(xué)生和學(xué)校的紐帶與聯(lián)系,幫助青少年自我探索,以此增強(qiáng)該類犯罪預(yù)防的針對性與實效性。
[Abstract]:In judicial practice, Non-rational crime cases of college students have the characteristics of slight inducement and serious adverse consequences. The article takes the 2010-2014 Chinese judgment papers net China's 11 provinces and cities of China 14-34 years old 21 college students because of trivial life. To commit an irrational crime as a sample, By studying the present situation and characteristics of this kind of crime, it is pointed out that the personality defects of the students involved and the psychological characteristics of low self-control or low self-restraint are the fundamental reasons for causing negative emotions and criminal behavior. On the one hand, by raising the level of parents' education and improving the quality of family education, it is proposed to strengthen the emotional connection between the youth and the family and form a sound personality, on the other hand, to strengthen the comprehensive management through the school. Especially to strengthen the ties and contacts between college students and schools, help teenagers to explore themselves, so as to enhance the pertinence and effectiveness of crime prevention.
