【摘要】：未成年人是未來祖國的棟梁,是國家和中華民族的希望。未成年人身心是否健康成長,決定了祖國和中華民族能否實(shí)現(xiàn)中國夢的理想。一旦未成年人犯罪,不僅損害到了社會的公眾利益,更加有可能毀掉了未成年人的一生。因此,我國在對未成年人犯罪量刑時制定了比成年人犯罪輕緩化的量刑原則。但近年來,未成年人犯罪率、再犯罪率急劇升高以及犯罪年齡低齡化等問題日益凸顯,成為我國現(xiàn)在一個日趨嚴(yán)重的社會問題。為了抑制這個社會問題的發(fā)展,我國的法律法規(guī)及司法解釋不斷完善其規(guī)定,但仍未得到改善。本文通過對我國未成年犯罪量刑制度司法適用的研究,試圖找出近年來我國未成年犯罪人數(shù)日益增多、再犯罪率不斷上升的原因。通過實(shí)踐調(diào)研和數(shù)據(jù)分析的方法,得出導(dǎo)致我國未成年犯罪人數(shù)日益增多、再犯罪率不斷上升的結(jié)果是源于我國未成年犯罪量刑制度在司法適用過程中存在刑罰適用不合理、量刑不平衡、社會配套制度不完善等問題。因此,得出的研究結(jié)論是要想解決我國未成年犯罪人數(shù)日益增多、再犯罪率不斷上升的問題就必須在司法實(shí)踐過程中,科學(xué)合理適用我國未成年犯罪量刑制度對未成年人犯罪問題具有重要的研究價值和實(shí)踐意義。
[Abstract]:Minors are the pillars of the future motherland and the hope of the country and the Chinese nation. The healthy growth of minors' bodies and minds determines whether the motherland and the Chinese nation can realize Chinese Dream's ideal. Once minors commit crimes, It not only damages the public interest of the society, but also destroys the life of the minor. Therefore, our country has formulated the sentencing principle which is lighter than that of the adult in sentencing the juvenile crime. But in recent years, the juvenile crime rate, The problems of the sharp rise of the crime rate and the younger age of the crime have become increasingly serious social problems in our country. In order to restrain the development of this social problem, the laws, regulations and judicial interpretations of our country have constantly perfected its provisions. However, it has not been improved. Through the research on the judicial application of sentencing system of juvenile crime in China, this paper tries to find out that the number of juvenile crimes in China is increasing day by day in recent years. Through practical investigation and data analysis, we can draw a conclusion that the number of underage crimes in our country is increasing day by day. The result of the rising crime rate is that the sentencing system of juvenile crime in our country has some problems such as unreasonable application of penalty, unbalanced sentencing, imperfect social supporting system and so on. The conclusion of the study is that in order to solve the problem that the number of juvenile crimes is increasing day by day and the rate of recidivism is rising, we must do so in the course of judicial practice. Scientific and reasonable application of sentencing system for juvenile crime in China has important research value and practical significance.
