【摘要】：我國現(xiàn)行經(jīng)濟刑法的規(guī)制范圍基本合理,在局部上既存在著過度犯罪化的問題,也存有進一步犯罪化的需要。經(jīng)濟刑法的保護法益應當被界定為國家和社會在經(jīng)濟活動中的經(jīng)濟利益,經(jīng)濟刑法的規(guī)制范圍應當建立在保護法益之上�，F(xiàn)行經(jīng)濟刑法的規(guī)制范圍應當從經(jīng)濟刑法的體系調(diào)整、經(jīng)濟刑法的非犯罪化和經(jīng)濟刑法的犯罪化等三個不同的方面加以完善。應當增設"侵犯勞動權(quán)益罪",以作為刑法分則第三章第九節(jié);應當廢止虛報資本罪,虛假出資、抽逃出資罪,騙取貸款罪,非法經(jīng)營同類營業(yè)罪,高利轉(zhuǎn)貸罪,生產(chǎn)、銷售偽劣產(chǎn)品罪;應當增設協(xié)議壟斷罪、濫用市場支配地位罪、非法集中罪和騙取社會福利罪。
[Abstract]:The scope of the current economic criminal law in China is basically reasonable, and there is a problem of excessive crime in some areas. There is also a need for further criminalization. The benefits of the protection of economic criminal law should be defined as the economic interests of the state and society in economic activities, The scope of regulation of economic criminal law should be established on the basis of the law of protection, and the scope of regulation of current economic criminal law should be adjusted from the system of economic criminal law. The decriminalization of the economic criminal law and the criminalization of the economic criminal law should be perfected in three different aspects. The crime of infringing on the rights and interests of labor should be added as section 9th of the third chapter of the special provisions of the criminal law, and the crime of false capital reporting should be abolished, and the false capital contribution should be abolished. The crime of withdrawing capital contribution, defrauding loans, illegally operating the same kind of business, transferring loans with usury, producing and selling fake and inferior products, should be added to the crime of agreement monopoly, the crime of abusing market dominant position, the crime of illegal centralization and the crime of defrauding social welfare.
