拒不支付勞動報(bào)酬罪若干問題分析

【摘要】:經(jīng)濟(jì)在發(fā)展,人民生活水平在增長,原本帶給社會的應(yīng)該是和諧,然而事實(shí)并非如此,在爆發(fā)的多種社會問題中,欠薪問題愈演愈烈,已經(jīng)嚴(yán)重威脅到了社會的穩(wěn)定,當(dāng)然這也不是我們社會主義國家獨(dú)有的“特色”現(xiàn)象,很多發(fā)達(dá)的資本主義國家也時(shí)有發(fā)生,面對這些問題,其它各國(地區(qū)),包括我國的香港、臺灣等都將拒不支付勞動報(bào)酬的行為列入了憲法、刑法、行政法等法律的規(guī)制范圍之內(nèi)。 由于用工主體拖欠勞動者報(bào)酬引發(fā)勞動者自殘、上訪等惡劣事件在我國也不斷“上演”,終于在2011年2月25日,全國人大常委會審議并通過了《刑法修正案(八)》,將“拒不支付勞動報(bào)酬罪”作為276條之一,這是我國正式動用刑罰權(quán)懲治用工主體拖欠勞動者工資的行為。由于司法適用標(biāo)準(zhǔn)各地司法機(jī)關(guān)很難掌握運(yùn)用,最高人民法院最終于2013年1月23日發(fā)布了《關(guān)于審理拒不支付勞動報(bào)酬刑事案件適用法律若干問題的解釋》,明確了拒不支付勞動報(bào)酬罪的定罪量刑標(biāo)準(zhǔn),這給執(zhí)法者帶了雨露。 本文通過對拒不支付勞動報(bào)酬罪的立法的緣由、基本概念、犯罪構(gòu)成、司法解釋等方面分析,圍繞拒不支付勞動報(bào)酬罪在現(xiàn)實(shí)中存在的問題,執(zhí)法中遇到的瓶頸等提出了建議,以期對未來我國完善法規(guī)提供借鑒,從根源上抑制拖欠勞動者報(bào)酬的事件發(fā)生。 本文正文的第一部分主要對拒不支付勞動報(bào)酬罪的背景、目的、意義、方法來討論將該罪收納在刑法中的必要性。第二部分進(jìn)一步明晰了拒不支付勞動報(bào)酬罪的概念,區(qū)別了此罪與彼罪的不同與相似之處,使得對該罪有一個(gè)準(zhǔn)確的把握。第三部分對該罪的犯罪構(gòu)成進(jìn)行了分析。第四部分對該罪在《解釋》中出現(xiàn)的相關(guān)內(nèi)容進(jìn)行了分析。第五部分結(jié)合我國實(shí)際情況,對該罪司法解釋的待完善問題進(jìn)行了詳述,提出幾點(diǎn)自己的建議,以期對將來的立法能夠作出一定的貢獻(xiàn)。第六部分對其它國家(地區(qū))關(guān)于拒不支付勞動報(bào)酬法律或說規(guī)定進(jìn)行了分析,總結(jié)了值得借鑒的內(nèi)容,期望對完善我國的相關(guān)法律法規(guī)有所幫助。
[Abstract]:In the development of economy, people's living standards in the growth, originally to society should be harmonious, but the fact is not true, in a variety of social problems erupted, wages problem intensified, has been a serious threat to the stability of society, of course, this is not our socialist country's unique "characteristics" phenomenon, many developed countries also have occurred, in the face of these problems, other countries (regions), including China's Hongkong, Taiwan and so on will be refused to pay labor remuneration behavior included in the constitution, criminal law, administrative law and other laws within the scope of regulation.
Due to the arrears of workers paid by workers employment subject to self mutilation, petitions and other adverse events in our country have been staged, and finally in February 25, 2011, the NPC Standing Committee examined and adopted the "criminal law amendment (eight)", "crime of refusing to pay labor remuneration as one of 276, which is China's official penalty the right to punish employment subject to the payment of workers' wages behavior. Because of the judicial applicable standards throughout the judicial organs is difficult to grasp, the Supreme People's Court on January 23, 2013 issued a final" on the trial of refusing to pay labor remuneration applicable law in Criminal Cases Interpretation of several issues ", the standard of conviction and punishment of the crime of refusing to pay remuneration, which brought rain to law enforcement.
This article through the legislative reason for refusing to pay labor remuneration crime concept, constitution of crime, analysis of judicial interpretation, the crime of refusing to pay labor remuneration problems in reality, proposed law enforcement encountered bottleneck, in order to provide reference for the future of our country to perfect the laws and regulations, the arrears of workers returns from the root. Inhibition of events
In the first part of the main body of crime of refusing to pay labor remuneration in the background, purpose, significance, methods to discuss the necessity of the crime in the criminal law included. The second part further clarifies the concept of crime of refusing to pay labor remuneration, the difference between this crime and other crime with different similarities, makes it a an accurate grasp of the crime. The third part of the crime of crime are analyzed. The fourth part of the crime in the interpretation of relevant content in < > was analyzed. The fifth part of the actual situation in our country, the crime of judicial interpretation to improve the problem in detail, put forward some the proposal, in order to make some contribution to the future. The sixth part of the legislation to other countries (regions) for refusing to pay labor remuneration or legal provisions are analyzed, summarizes the valuable content, expectations for the perfection of our Relevant laws and regulations help.
