【摘要】：為了突破傳統(tǒng)刑事司法合作的局限性,歐盟以各成員國之間的相互信任為基礎,將相互承認原則確立為刑事司法合作的基石。相互承認可以適用于刑事訴訟各個階段做出的司法裁定,其合作范圍大大超過傳統(tǒng)司法合作范圍。相互承認制度下的司法合作在司法機關之間直接開展,極大簡化了合作程序,加快了合作速度,并在一定范圍內取消了雙重犯罪原則和特定性原則,不適用本國國民不移交原則。相互承認司法裁定制度促進了歐盟各國的法律趨同,同時在法律有差異的情況下,通過規(guī)定拒絕承認或執(zhí)行的理由來縮小合作義務的范圍。
[Abstract]:In order to overcome the limitations of traditional criminal justice cooperation, the EU is based on mutual trust among member States. Establishing the principle of mutual recognition as the cornerstone of criminal justice cooperation... mutual recognition may apply to judicial decisions made at all stages of criminal proceedings, The scope of cooperation greatly exceeds the scope of traditional judicial cooperation. Judicial cooperation under the system of mutual recognition develops directly between the judicial organs, greatly simplifying the cooperation procedures and speeding up the pace of cooperation, To a certain extent, the principle of dual criminality and the principle of specificity are abolished, and the principle of non-transfer of nationals is not applied. Mutual recognition of the judicial adjudication system promotes the convergence of laws among the countries of the European Union, while at the same time, where there are differences in law, To narrow the scope of the obligation to cooperate by prescribing grounds for refusal to recognize or enforce.
