【摘要】：《刑法修正案九》第29條規(guī)定明知他人利用計算機(jī)網(wǎng)絡(luò)實施犯罪,而為其提供技術(shù)幫助的,處三年以下有期徒刑或者拘役,并處或者單處罰金。有觀點認(rèn)為這是幫助犯的正犯化,但究其實質(zhì)內(nèi)涵,此處規(guī)定的幫助犯依然符合共犯的基本構(gòu)成要件,只不過對傳統(tǒng)的共犯理論有所突破,弱化了其意思聯(lián)絡(luò)的要件,而強化了共同實行行為要件。而這種"無通謀"的幫助犯的成立也為處罰中立幫助犯提供了法律依據(jù)。
[Abstract]:Article 29 of the Ninth Amendment to the Criminal Law stipulates that whoever provides technical assistance to a person who knowingly commits a crime using a computer network shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention. It is believed that this is the principal offence of aiding an offender, but the essence of it is that the assistive offender here still accords with the basic constituent elements of an accomplice, but it is only a breakthrough in the traditional theory of accomplice. It weakens the elements of communication of intention and strengthens the elements of joint practice, and the establishment of this kind of "unpremeditated" helper also provides a legal basis for the punishment of neutral helper.
