生產(chǎn)、銷售有毒、有害食品罪相關(guān)問題研究

【摘要】:食品是人們生存與發(fā)展的必需物質(zhì),安全的食品更是其基礎(chǔ)與保障。目前,社會大眾也已普遍重視食品安全問題。生產(chǎn)、銷售有毒、有害食品罪是危害食品安全犯罪中最嚴重的一種犯罪,本罪在打擊食品領(lǐng)域的犯罪行為,保障公眾生命健康合法權(quán)益,維護市場經(jīng)濟秩序等方面起著重要的作用。對本罪的研究分析,有著重要的現(xiàn)實意義。除了引言外,本文的主要內(nèi)容分為五個部分:筆者在本文的第一部分中,綜合了理論界對本罪的既遂形態(tài)的各種觀點,通過深入探析,得出本罪屬于典型的抽象危險犯的結(jié)論。在本文的第二部分中,筆者重新定位本罪的行為類型,將本罪的行為分為“生產(chǎn)”和“銷售”。筆者認為,“摻入行為”只是生產(chǎn)行為中最重要的一個組成部分,但不是能單獨歸為一種行為類型。在第三部分中,筆者對本罪行為對象的相關(guān)問題進行了探究。筆者認為本罪中“食品”的范圍不應(yīng)包括“食品添加劑”在內(nèi);“非食品原料”則是指加入食品中的除了生產(chǎn)加工食品的原料性物質(zhì)之外的其他物質(zhì)。同時筆者也對“有毒”“有害”相關(guān)問題進行了認真地分析研究;在實踐中,對于“有毒”、“有害”的認定需要依據(jù)客觀鑒定。對有毒、有害的非食品原料的認定應(yīng)由省級以上衛(wèi)生行政部門指定的鑒定機構(gòu)做出。在第四部分中,筆者主要研究了行為人主觀“明知”的基本內(nèi)容。行為人主觀上的明知與否,是區(qū)別罪與非罪的重要因素。第五部分指出本罪在刑事立法方面的不足之處,如刑罰體系設(shè)置的不合理等問題,并提出要完善刑事責(zé)任體系,增設(shè)資格刑的建議?傊,食品安全的重要性是有目共睹的,因此對本罪的研究有著重要的意義。這不僅能夠減少食品犯罪的數(shù)量,保障人民群眾的生體健康與生命安全,更有益于我國的法制建設(shè),從而實現(xiàn)我國構(gòu)建和諧社會這一偉大目標(biāo)。
[Abstract]:Food is the essential material for people's survival and development, and safe food is its foundation and guarantee. At present, the general public has also attached great importance to the problem of food safety. The crime of harmful food is one of the most serious crimes against food safety. The crime is aimed at cracking down on criminal acts in the field of food and safeguarding the legitimate rights and interests of public life and health. The research and analysis of this crime has important practical significance. Besides the introduction, the main content of this paper is divided into five parts: the author in the first part of this article, This paper synthesizes all kinds of viewpoints of the accomplished form of this crime in the theoretical circle, through the thorough analysis, draws the conclusion that this crime belongs to the typical abstract dangerous crime. In the second part of this article, the author redefines the behavior type of this crime. The behavior of this crime is divided into "production" and "sale". The author thinks that "adulteration" is only one of the most important components of the production behavior, but it can not be classified as a single type of behavior. In the third part, The author probes into the related problems of the object of this crime. The author thinks that the scope of "food" in this crime should not include "food additive", and "non-food raw material" refers to the addition of food in addition to the production and processing of food. At the same time, the author has carried on the careful analysis and research to the "toxic" "harmful" related problems; In practice, the identification of "toxic" and "harmful" should be based on objective identification. The identification of toxic and harmful non-food raw materials should be made by an appraisal agency designated by the administrative department of health at or above the provincial level. In part 4th, The author mainly studies the basic content of the subjective "knowing" of the perpetrator. The subjective knowledge or not is the important factor to distinguish the crime from the non-crime. Part 5th points out the deficiency of the crime in the criminal legislation. Such as the unreasonable setting of the penalty system, and put forward the suggestion of perfecting the criminal responsibility system and increasing the qualification penalty. In short, the importance of food safety is obvious to all. Therefore, the study of this crime is of great significance. It can not only reduce the number of food crimes, protect the health and safety of the people, but also benefit the legal construction of our country. In order to achieve the great goal of building a harmonious society in China.
