【摘要】：銀行卡犯罪不是刑法上的獨(dú)立罪名,而是一個(gè)集合性犯罪概念,是涉及信用卡、妨害信用卡管理秩序的相關(guān)犯罪總稱。針對(duì)銀行卡犯罪,國家近年來出臺(tái)了一系列法律法規(guī),包括《關(guān)于辦理利用信用卡詐騙犯罪案件具體適用法律若干問題的解釋》、《關(guān)于懲治金融犯罪的決定》等。但現(xiàn)行法律法規(guī)關(guān)于銀行卡詐騙罪及打擊處理程序規(guī)定仍然存在一些缺陷和不足。筆者結(jié)合近年發(fā)生的信用卡犯罪典型案例,圍繞犯罪形式發(fā)展、作案手段變化、司法打擊防控中遇到的困難予以分析,并提出相應(yīng)打防對(duì)策。
[Abstract]:Bank card crime is not an independent crime in criminal law, but a collective crime concept. It is a general name of related crimes involving credit card and impairing the management order of credit card. In recent years, the country has issued a series of laws and regulations, including "on the use of credit card fraud cases specific to the application of certain issues of the interpretation of the law". Decision on punishing Financial Crime, etc. However, there are still some defects and deficiencies in the current laws and regulations concerning the crime of bank card fraud and the procedures for dealing with the crackdown. The author combines the typical cases of credit card crimes that have occurred in recent years. Based on the development of crime form, the change of crime means, the difficulties encountered in judicial attack and control are analyzed, and the corresponding countermeasures are put forward.
