【摘要】：罪犯順利回歸社會(huì)不再犯罪是刑罰執(zhí)行的最終目標(biāo),但是我國(guó)傳統(tǒng)的報(bào)復(fù)主義思想過(guò)于嚴(yán)重,導(dǎo)致監(jiān)獄改造罪犯和社區(qū)矯正罪犯面臨著很大困難。本文通過(guò)對(duì)監(jiān)獄和社區(qū)改造罪犯的思想、方法、管理人員素養(yǎng)及罪犯出獄后的保護(hù)制度等多方面進(jìn)行了研究,并提出了合理化建議,促進(jìn)罪犯的再社會(huì)化進(jìn)程。本文除前言外共分為五個(gè)部分:第一部分:罪犯再社會(huì)化概述本章首先對(duì)罪犯、社會(huì)化、社區(qū)矯正等相關(guān)概念進(jìn)行了解釋,便于文章的理解,其次又對(duì)罪犯再社會(huì)化國(guó)內(nèi)外思想的產(chǎn)生過(guò)程及發(fā)展現(xiàn)狀進(jìn)行了闡述。最后對(duì)罪犯再社會(huì)的意義和特征進(jìn)行了論述。第二部分:罪犯再社會(huì)化的可行性本章對(duì)監(jiān)獄和社區(qū)罪犯再社會(huì)化可行的基礎(chǔ)條件進(jìn)行了解讀,從法規(guī)制度、社會(huì)環(huán)境以及探索經(jīng)驗(yàn)等幾個(gè)方面論證了罪犯再社會(huì)化具有可行性。第三部分:我國(guó)罪犯再社會(huì)化現(xiàn)狀本章首先對(duì)監(jiān)獄罪犯再社會(huì)化面臨分布不合理、刑罰執(zhí)行封閉、教育改造簡(jiǎn)單、人員素質(zhì)參差不齊、非監(jiān)禁刑發(fā)展滯后等五個(gè)方面的的問(wèn)題進(jìn)行了描述及分析,其次對(duì)社區(qū)服刑罪犯再社會(huì)化面臨思想觀念落后、社區(qū)矯正滯后、法律不健全、人員專業(yè)性差等四個(gè)方面進(jìn)行了分析。最后對(duì)出獄人保護(hù)制度的薄弱問(wèn)題進(jìn)行了簡(jiǎn)單的描述。第四部分:我國(guó)罪犯再社會(huì)化制度構(gòu)建本章對(duì)罪犯再社會(huì)化面臨的問(wèn)題提出了合理化建議,一方面是對(duì)監(jiān)獄的改革:要合理化監(jiān)獄布局、推進(jìn)開(kāi)放式處遇、教育改造要社會(huì)化、建立專業(yè)化的監(jiān)獄警察隊(duì)伍、發(fā)展非監(jiān)禁刑等;另一方面是對(duì)社區(qū)矯正的改革:建立正確社區(qū)矯正觀念、推進(jìn)現(xiàn)代社區(qū)建設(shè)、《制定社區(qū)矯正法》、建立專業(yè)社區(qū)矯正隊(duì)伍等。最后對(duì)出獄保護(hù)制度進(jìn)行了完善化建議。第五部分:結(jié)論本章對(duì)全文進(jìn)行了總結(jié),罪犯再社會(huì)化是一項(xiàng)復(fù)雜龐大的工程,我國(guó)需要從實(shí)際出發(fā),從觀念、立法、制度、技術(shù)等多方面進(jìn)行改革,不斷完善我國(guó)罪犯再II社會(huì)化制度。社會(huì)化制度。
[Abstract]:Criminals return to society without any crime is the ultimate goal of penalty execution, but our traditional retaliation ideology is too serious, which leads to great difficulties in prison reform criminals and community corrections criminals. In this paper, we have studied the thoughts and methods of prison and community transformation, the quality of managers, and the protection system of criminals after being released from prison, and put forward rationalization proposals to promote the process of re socialization of criminals. This paper is divided into five parts besides the preface: the first part: the overview of criminal re socialization of the first chapter of criminals, socialization, community correction and other related concepts are explained, for the understanding of the process and current situation of development secondly on the socialization of criminals abroad thought are described. Finally, the significance and characteristics of the criminal re - society are discussed. The second part: the feasibility of re socialization of criminals. This chapter interprets the feasible basic conditions of prison and community criminals' re socialization, and demonstrates the feasibility of re socialization of criminals from several aspects, such as laws and regulations, social environment and exploration experience. The third part: our country criminal re socialization situation firstly re socialization facing the irrational distribution of the penalty closed, education reform is simple, the uneven quality of personnel of non imprisonment, lagging behind the development of the five aspects of the problem of prison criminals are described and analyzed, followed by the community prisoners re socialization of ideological the concept behind the community correction lag, the law is not perfect, not professionals in four aspects of the analysis. In the end, a brief description is made of the weak issue of the protector's protection system. The fourth part: our country criminal re socialization system this chapter of criminal re socialization are put forward rationalization proposals, on the one hand, the prison reform: to rationalize the layout of the prison and promote the opening and development of social and educational reform to establish a specialized prison police team, non imprisonment punishment; on the other hand is the reform of community correction: to establish a correct concept of community correction, to promote the construction of modern community, "the development of community correction law", the establishment of professional community correction team. Finally, some suggestions are made to improve the system of prison protection. The fifth part: conclusion: this chapter summarizes the full text. The re socialization of criminals is a complex and huge project. Our country needs to start from reality, reform from many aspects such as concept, legislation, system and technology, and constantly improve our criminal II re socialization system.
