【摘要】：本文從農(nóng)村房屋征收的依據(jù)、房屋征收補(bǔ)償標(biāo)準(zhǔn)、征收補(bǔ)償?shù)姆秶�、征收程序的不�?guī)范、司法救濟(jì)途徑的不暢以及征收權(quán)缺乏必要的限制等方面，闡釋我國(guó)農(nóng)村房屋征收補(bǔ)償活動(dòng)中存在的主要問(wèn)題，并對(duì)上述問(wèn)題產(chǎn)生的主要原因進(jìn)行分析，，在此基礎(chǔ)上提出應(yīng)對(duì)上述問(wèn)題的相關(guān)措施和建議，本文主張通過(guò)以列舉的方式界定公共利益，規(guī)范農(nóng)村房屋征收程序，制定合理的補(bǔ)償標(biāo)準(zhǔn)，擴(kuò)大補(bǔ)償?shù)姆秶�，完善房屋價(jià)值的評(píng)估機(jī)制以及制定專(zhuān)門(mén)的集體土地上房屋征收補(bǔ)償條例等具體措施，更好地實(shí)現(xiàn)規(guī)制和解決農(nóng)村房屋征收補(bǔ)償活動(dòng)過(guò)程中出現(xiàn)的相關(guān)問(wèn)題。
[Abstract]:This article from the rural housing expropriation basis, the housing expropriation compensation standard, the expropriation compensation scope, the expropriation procedure is not standardized, the judicial relief way is not smooth and the expropriation right lacks the necessary restriction and so on. This paper explains the main problems existing in the expropriation and compensation activities of rural housing in China, analyzes the main causes of the above problems, and on this basis, puts forward some relevant measures and suggestions to deal with the above problems. This paper advocates defining the public interest by enumerating, standardizing the expropriation procedure of rural housing, formulating reasonable compensation standards, and expanding the scope of compensation. To improve the evaluation mechanism of housing value and formulate special regulations on housing expropriation and compensation on collective land, so as to better regulate and solve the related problems in the process of rural housing expropriation and compensation activities.
