【摘要】：本文從農(nóng)村房屋征收的依據(jù)、房屋征收補償標準、征收補償?shù)姆秶�、征收程序的不�?guī)范、司法救濟途徑的不暢以及征收權(quán)缺乏必要的限制等方面，闡釋我國農(nóng)村房屋征收補償活動中存在的主要問題，并對上述問題產(chǎn)生的主要原因進行分析，，在此基礎上提出應對上述問題的相關措施和建議，本文主張通過以列舉的方式界定公共利益，規(guī)范農(nóng)村房屋征收程序，制定合理的補償標準，擴大補償?shù)姆秶�，完善房屋價值的評估機制以及制定專門的集體土地上房屋征收補償條例等具體措施，更好地實現(xiàn)規(guī)制和解決農(nóng)村房屋征收補償活動過程中出現(xiàn)的相關問題。
[Abstract]:This article from the rural housing expropriation basis, the housing expropriation compensation standard, the expropriation compensation scope, the expropriation procedure is not standardized, the judicial relief way is not smooth and the expropriation right lacks the necessary restriction and so on. This paper explains the main problems existing in the expropriation and compensation activities of rural housing in China, analyzes the main causes of the above problems, and on this basis, puts forward some relevant measures and suggestions to deal with the above problems. This paper advocates defining the public interest by enumerating, standardizing the expropriation procedure of rural housing, formulating reasonable compensation standards, and expanding the scope of compensation. To improve the evaluation mechanism of housing value and formulate special regulations on housing expropriation and compensation on collective land, so as to better regulate and solve the related problems in the process of rural housing expropriation and compensation activities.
