【摘要】：如果把以憲法為核心的公法實施通俗地表述為"公事公辦",就會更加真切地體會到"公事公辦"實現(xiàn)的艱難。若要破解諸種困難,首先需要具備憲法工程思維;其次,在憲法工程思維的引領(lǐng)之下,嚴(yán)格遵循現(xiàn)代社會轉(zhuǎn)型所蘊含的二元論思維原理,并以此作為設(shè)想與建立相應(yīng)憲法技術(shù)構(gòu)造的路徑。為了具體應(yīng)用二元論思維,使中國憲法技術(shù)構(gòu)造更加具體化,針對中國式的法官獨立問題,建立了"預(yù)付薪酬制"這一憲法技術(shù)構(gòu)造方案。
[Abstract]:If the implementation of public law with the Constitution as the core is commonly expressed as "public affairs", it will be more truly aware of the difficulties in realizing "public affairs". If we want to solve all kinds of difficulties, we need to have the thinking of constitutional engineering first. Secondly, under the guidance of constitutional engineering thinking, we strictly follow the dualistic thinking principle contained in the transformation of modern society, and take it as the way to imagine and establish the corresponding constitutional technical structure. In order to apply dualistic thinking and make the technical structure of Chinese constitution more concrete, a constitutional technical construction scheme of "prepaid salary system" is established in view of the independence of judges in Chinese style.
