【摘要】：政黨足現(xiàn)代國家發(fā)展的產(chǎn)物,經(jīng)過了近三百年的發(fā)展,政黨及政黨政治已成為現(xiàn)代國家不可或缺的重要部分。在現(xiàn)代國家中,政黨幾乎涉足了國家與社會生活中最重要的部分。正如意大利學(xué)者薩托利所言：“如果說現(xiàn)代政治有什么特別‘現(xiàn)代’的東西,那就是……現(xiàn)代政治需要政黨的引導(dǎo),即使在不存在多個政黨的時間和地點,也需要一個單一的政黨�！笨梢哉f,近代國家與現(xiàn)代國家的標(biāo)志性區(qū)別就是政黨政治。政黨政治是一種以政黨為不可或缺的政治實體,圍繞著政黨如何控制政權(quán)、運用政權(quán)使得其政策得以貫徹實施的制度。政黨政治的核心在于民主制,形成標(biāo)志為現(xiàn)代普選制。政黨政治的核心不在于政黨本身,而在于民主在政黨這個小環(huán)境與國家這個大環(huán)境下,如何分配權(quán)利義務(wù),制定組織結(jié)構(gòu),使國家得以良好運轉(zhuǎn)。在政黨政治持續(xù)發(fā)展的今天,其規(guī)范化和法制化就成了矚目的焦點問題。研究政黨法律制度,可以明晰政黨政治的核心內(nèi)容及其規(guī)范化前景,對法律制度對政黨政治的影響進行評析,并吸收借鑒國外政黨法制發(fā)展中的經(jīng)驗教訓(xùn),為我國政黨政治實現(xiàn)規(guī)范化法制化打下基礎(chǔ)。本文第一部分為政黨法律制度概況,梳理了政黨基本概念和政黨政治的基本特征,對政黨制產(chǎn)生的兩百多年內(nèi)與政黨有關(guān)的法律制度的發(fā)展歷程進行了回顧；第二部分為政黨法律制度的核心內(nèi)容,通過總結(jié)與政黨及政黨政治有關(guān)的若干社會關(guān)系,得出政黨法律制度應(yīng)具備的基本內(nèi)容；第三部分為我國政黨法制現(xiàn)狀及述評,總結(jié)了我國現(xiàn)行與政黨有關(guān)的法律規(guī)定,指出現(xiàn)行政黨法律制度的不足之處,提出應(yīng)進行政黨法制改革；第四部分為我國政黨法制改革路徑之選擇,在第三部分的基礎(chǔ)上對可能的改革方案進行了探討,提出我國政黨法制改革應(yīng)走以《政黨法》為中心,多種立法措施相結(jié)合的道路,并提出了我國政黨法可遵循的基本原則,并在參考別國相關(guān)立法的基礎(chǔ)上,提出我國《政黨法》的基本內(nèi)容與基本體例,并對修改其他相關(guān)法律提出建議。
[Abstract]:After nearly 300 years of development, the party and party politics have become an indispensable part of the modern country. In modern countries, political parties are almost involved in the most important part of national and social life. As the Italian scholar Satoli put it: "if there is anything special about modern politics, it is." Modern politics requires the guidance of political parties, even in the absence of multiple political parties at a time and place, also a single party. " It can be said that the signature difference between modern and modern countries is party politics. Party politics is a kind of political entity which takes the political party as the indispensable political entity, around how the political party controls the political power, uses the political power to make its policy carry out the system. The core of party politics lies in democracy, which is marked by modern universal election system. The core of party politics is not the party itself, but the democracy in the small environment of the political party and the national environment, how to allocate the rights and obligations, formulate the organizational structure, so that the country can function well. In the continuous development of party politics today, its standardization and legalization has become the focus of attention. The study of the legal system of political parties can clarify the core content of political party politics and its standardized prospects, evaluate the impact of the legal system on the political party politics, and absorb the lessons learned from the development of the legal system of political parties abroad. It lays a foundation for the realization of standardization and legalization of party politics in our country. The first part of this paper is an overview of the legal system of the political party, combing the basic concept of the political party and the basic characteristics of the political party, and reviewing the development of the legal system related to the political party in the more than two hundred years of the emergence of the system of the political party; The second part is the core content of the legal system of the political party, through summarizing some social relations related to the political party and the political party politics, we can get the basic content that the legal system of the political party should have. The third part is the current situation and review of the legal system of the political parties in China, summarizes the existing legal provisions related to the political parties in China, points out the shortcomings of the current legal system of the political parties, and proposes that the legal reform of the political parties should be carried out. The fourth part is the choice of the path of the political party legal system reform in our country. On the basis of the third part, the paper discusses the possible reform plan, and puts forward that the political party legal system reform of our country should take the political party law as the center and combine the various legislative measures. On the basis of referring to the relevant legislation of other countries, this paper puts forward the basic content and basic style of our country's political party law, and puts forward some suggestions for amending other relevant laws.
