【摘要】：以憲法中的公共利益條款為視角,分析2004年以來(lái)北京市在城市改造過(guò)程中所依據(jù)的規(guī)章,表明在《北京市國(guó)有土地上房屋征收與補(bǔ)償實(shí)施意見(jiàn)》出臺(tái)之前,北京市的城市房屋拆遷許可條件并不必然要求每一個(gè)強(qiáng)制性拆遷項(xiàng)目都出于公共利益目的;在沒(méi)有清楚界定"公共利益"的情況下,這些操作性更強(qiáng)的許可條件就自然成為房屋征收程序中的具體指引,因而憲法中的"公共利益"要求在現(xiàn)實(shí)中很可能被忽視。
[Abstract]:From the perspective of the public interest clause in the Constitution, this paper analyzes the rules and regulations in the process of urban transformation in Beijing since 2004, and shows that before the publication of the opinions on the implementation of Housing Collection and compensation on State-owned Land in Beijing, The permit conditions of urban house demolition in Beijing do not necessarily require that every compulsory demolition project is for the purpose of public interest. In the absence of a clear definition of "public interest", these more operational licensing conditions naturally become specific guidelines in the housing expropriation process, and the requirement of "public interest" in the Constitution is likely to be ignored in reality.
