我國土地發(fā)展權(quán)法律問題研究

【摘要】:土地發(fā)展權(quán)是變更土地用途之權(quán),乃事關(guān)土地資源優(yōu)化合理配置的一種新的權(quán)利形態(tài)。目前,我國關(guān)于土地利用的法律制度主要為土地使用權(quán)制度和土地用途管制制度。土地使用權(quán)對(duì)土地的使用僅在土地用途形態(tài)確定后對(duì)土地的利用,不涉及土地用途的變更,對(duì)優(yōu)化配置土地資源存在一種先天不足。土地用途管制制度確立的是國家的行政審批權(quán)。行政審批權(quán)立足國家本位,追求國家利益,片面強(qiáng)調(diào)國家干預(yù)機(jī)制調(diào)節(jié)土地用途變更關(guān)系,忽視市場機(jī)制對(duì)土地用途變更關(guān)系的作用,亦忽視市場和政府對(duì)土地用途變更關(guān)系的綜合調(diào)節(jié)。從這個(gè)意義而言,行政審批權(quán)是對(duì)變更土地用途、優(yōu)化土地資源配置的一種悖離。 土地發(fā)展權(quán)法律制度可彌補(bǔ)上述兩種制度優(yōu)化配置土地資源之不足,為緩解人地關(guān)系中的根本矛盾人對(duì)土地的無限需求性和土地的極大稀缺性之間的矛盾提供了一種新的制度選擇。 本文從以下四個(gè)部分來描述土地發(fā)展權(quán)這種新穎而重要的權(quán)利形態(tài)。 第一部分,土地與土地用途。本部分界定法學(xué)視野中的土地的質(zhì)的規(guī)定性和外延,為科學(xué)設(shè)計(jì)土地發(fā)展權(quán)法律制度奠定前提和基礎(chǔ)。土地發(fā)展權(quán)乃變更土地用途之權(quán),這里的土地用途乃是立法上的土地用途,故土地發(fā)展權(quán)應(yīng)是變更土地用途法定形態(tài)之權(quán)。探討土地用途的法定形態(tài)之法理,為揭示土地發(fā)展權(quán)的具體內(nèi)容的前提條件。 第二部分,土地發(fā)展權(quán)概述。這里闡述土地發(fā)展權(quán)的內(nèi)涵與外延、具體內(nèi)容、基本原則,從總的方面揭示土地發(fā)展權(quán)法律制度之特征。土地發(fā)展權(quán)內(nèi)含可持續(xù)發(fā)展之理念,關(guān)注土地的社會(huì)整體經(jīng)濟(jì)效益與生態(tài)效益,追求代內(nèi)人和代際人的土地安全與生態(tài)安全之目標(biāo)。 第三部分,土地發(fā)展權(quán)的正當(dāng)性研究。研究土地發(fā)展權(quán)的正當(dāng)性,旨在昭示土地發(fā)展權(quán)之重要意義。目前,我國關(guān)于土地利用的法律制度主要為土地使用權(quán)制度和土地用途管制制度。上述兩種制度均不能充分滿足人們對(duì)土地的極大需求,對(duì)優(yōu)化土地資源配置存在某種不足。土地發(fā)展權(quán)法律制度可彌補(bǔ)上述兩種制度優(yōu)化配置土地資源之不足,為緩解人地關(guān)系中的根本矛盾即人對(duì)土地的無限需求性和土地的極大稀缺性之間的矛盾提供了一種新的制度選擇。筆者從理論和實(shí)踐兩個(gè)角度探究土地發(fā)展權(quán)的正當(dāng)性的命題。
[Abstract]:The right to land development is the right to change land use and is a new form of rights related to the optimal and rational allocation of land resources. At present, the legal system of land use in our country is mainly land use right system and land use control system. Land use right to land use only after the determination of land use form, land use does not involve land use changes, there is a natural deficiency to the optimal allocation of land resources. The land use control system establishes the state's power of administrative examination and approval. The power of administrative examination and approval is based on the state standard, pursues the interests of the state, and unilaterally emphasizes that the mechanism of state intervention regulates the relationship between land use change and neglects the role of the market mechanism in the relation of land use change. It also ignores the market and the government's comprehensive regulation of the land use change relationship. In this sense, the power of administrative examination and approval is a contradiction to the change of land use and the optimization of land resource allocation. The legal system of land development right can make up for the deficiency of the above two systems in optimizing the allocation of land resources. It provides a new institutional choice for alleviating the contradiction between the unlimited demand for land and the great scarcity of land. This paper describes the new and important form of land development right from the following four parts. The first part, land and land use. This part defines the definition and extension of the land quality in the legal field of view, and lays a foundation for the scientific design of the legal system of the land development right. The land development right is the right to change the land use, and the land use here is the legislative land use, so the land development right should be the right to change the legal form of the land use. To explore the legal principle of the legal form of land use is a prerequisite for revealing the specific content of land development right. The second part is an overview of land development right. This paper expounds the connotation and extension of the land development right, its concrete content and basic principles, and reveals the characteristics of the legal system of the land development right from the general aspect. The land development right contains the concept of sustainable development, pays close attention to the overall economic and ecological benefits of land, and pursues the goals of land security and ecological security of intergenerational and intergenerational people. The third part is the research on the legitimacy of land development right. The purpose of studying the legitimacy of land development right is to show the importance of land development right. At present, the legal system of land use in our country is mainly land use right system and land use control system. These two systems can not fully meet the great demand for land, and there are some deficiencies in optimizing the allocation of land resources. The legal system of land development right can make up for the deficiency of the above two systems in optimizing the allocation of land resources. It provides a new institutional choice for alleviating the contradiction between the unlimited demand for land and the great scarcity of land in the relationship between man and land. The author explores the proposition of the legitimacy of land development right from the angle of theory and practice.
