本文關(guān)鍵詞：淺析《公民及政治權(quán)利國際公約》中arrest與我國逮捕制度的差異——兼議arrest的翻譯，由筆耕文化傳播整理發(fā)布。

【摘要】：《公民及政治權(quán)利國際公約》現(xiàn)通行中文本中arrest對應(yīng)的措辭為"逮捕"。對比《公約》下"arrest"的要求可知,無論是《公約》第9條"arrest"的適用范圍、適用條件和程序還是錯誤逮捕的國家賠償認(rèn)定均有別于我國的逮捕制度。在堅持《公約》原則和精神的大前提下,矯正被異化的逮捕功能一方面要求"arrest"中文用語需符合《公約》的基本要求并建議將其譯為"拘捕";另一方面要求秉持現(xiàn)代法治理念進(jìn)一步完善非羈押性替代措施,嚴(yán)格提請逮捕的書面卷宗,調(diào)整逮捕審批閱卷方式,改變不合理的錯誤逮捕責(zé)任追究制度和評價機(jī)制。
