我國(guó)偵查權(quán)的程序控制

【摘要】:本文擬對(duì)從程序控制的角度,對(duì)公安機(jī)關(guān)刑事偵查權(quán)的控制問(wèn)題進(jìn)行研究。2012年刑事訴訟法的修改通過(guò)非法證據(jù)排除的完善等加強(qiáng)了對(duì)公安機(jī)關(guān)偵查權(quán)的控制,但是從學(xué)界討論及司法實(shí)踐來(lái)看,公安機(jī)關(guān)偵查違法的情形層出不窮且屢糾屢犯,刑訊逼供等嚴(yán)重偵查違法還時(shí)有發(fā)生,如何有效控制偵查權(quán)力的良性運(yùn)行、保障犯罪嫌疑人的基本權(quán)利依然是刑事訴訟中亟待解決的問(wèn)題。黨的十八屆四中全會(huì)“推進(jìn)以審判為中心的訴訟制度改革”“規(guī)范司法程序”系列司法改革對(duì)偵查權(quán)的程序控制提出了新要求,在司法改革背景下完善我國(guó)偵查權(quán)的程序控制就有了現(xiàn)實(shí)意義。偵查權(quán)的程序控制是指公安機(jī)關(guān)在行使偵查權(quán)時(shí)必須受到法定程序和正當(dāng)程序的制約和保障。從現(xiàn)有的立法規(guī)定來(lái)看,我國(guó)公安機(jī)關(guān)享有的偵查權(quán)內(nèi)容涉及廣泛,但基于程序控制的必要性以及可行性并結(jié)合司法實(shí)踐中出現(xiàn)的問(wèn)題,本文集中討論了立案權(quán)、訊問(wèn)權(quán)、搜查權(quán)、逮捕權(quán)、鑒定權(quán)以及技術(shù)偵查權(quán)的程序控制問(wèn)題。本文立足于司法實(shí)踐,通過(guò)調(diào)研走訪了解公安機(jī)關(guān)偵查權(quán)在實(shí)踐中的運(yùn)行狀況,在明確偵查權(quán)程序控制的現(xiàn)狀和缺陷的前提下,借鑒域外偵查權(quán)程序控制的合理因素,提出完善我國(guó)偵查權(quán)程序控制的具體措施。本文認(rèn)為,偵查權(quán)的程序控制有其存在的理論基礎(chǔ)。偵查權(quán)的強(qiáng)制暴力性、主動(dòng)性和單方性、擴(kuò)張性和侵犯性以及秘密性等本質(zhì)屬性決定了其運(yùn)行必須受到正當(dāng)程序的規(guī)制,正當(dāng)程序理念和強(qiáng)制偵查法定原則要求在偵查過(guò)程中使用強(qiáng)制偵查措施要符合法律規(guī)定的實(shí)體要件和程序要件。討論我國(guó)偵查權(quán)的程序控制應(yīng)堅(jiān)持以下理念:保障犯罪嫌疑人、被害人及社會(huì)公眾的基本權(quán)利,保障偵查權(quán)良性運(yùn)行,突出偵查權(quán)的基礎(chǔ)性與初始性地位,權(quán)力限制與自由裁量相平衡,突出偵查權(quán)重點(diǎn)權(quán)項(xiàng)的程序控制。本文對(duì)偵查權(quán)程序控制的立法現(xiàn)狀和實(shí)踐狀況進(jìn)行探討和分析,從目前的法律規(guī)定來(lái)看,我國(guó)現(xiàn)有的偵查權(quán)控制程序總體上表現(xiàn)為以內(nèi)部控制為主、檢察機(jī)關(guān)的審查與監(jiān)督為輔、其他控制形式為補(bǔ)充的程序控權(quán)機(jī)制。從實(shí)踐中的調(diào)研情況來(lái)看,偵查機(jī)關(guān)的內(nèi)部程序控制和檢察機(jī)關(guān)的監(jiān)督程序均發(fā)揮了一定的控制效果并呈現(xiàn)出新的特征。本文對(duì)我國(guó)偵查權(quán)程序控制的缺陷進(jìn)行了分析。偵查權(quán)程序控制從總體控制效果來(lái)看,內(nèi)部控制不足,檢察監(jiān)督乏力,程序性制裁仍存有缺陷。偵查權(quán)具體權(quán)項(xiàng)的控制程序也存在著許多不足,如立案權(quán)的審查和監(jiān)督程序隨意性大,非羈押狀態(tài)下的偵查訊問(wèn)權(quán)未得到規(guī)制,搜查權(quán)審批流于形式,審查批捕程序訴訟化構(gòu)造畸形,鑒定權(quán)缺乏外部制約程序等。本文提出了改革完善我國(guó)偵查權(quán)程序控制的建議。在明確偵查權(quán)程序控制的現(xiàn)狀和缺陷的前提下,綜合借鑒域外偵查權(quán)程序控制的合理因素,提出了完善我國(guó)偵查權(quán)程序控制整體的改革思路和具體完善措施,整體思路是加速程序正義司法理念形成,構(gòu)建訴訟化的審查程序,建立程序性制裁體系以及增強(qiáng)訴權(quán)制約偵查權(quán)程序。
[Abstract]:This paper intends to study the control of the criminal investigation right of the public security organ from the point of view of program control. The amendment of the Criminal Procedure Law in 2012 has strengthened the control of the investigation right of the public security organ through the perfection of the rule of the exclusion of the illegal evidence, but from the discussion of the academic circle and the judicial practice, In order to ensure the effective control of the benign operation of the investigation power, the basic right of the criminal suspect is still a problem to be solved in the criminal procedure. In this paper, the author holds that the control of the investigation power has the theoretical basis of its existence. The control of the investigation right in our country should adhere to the following concepts: to guarantee the criminal suspect, The basic rights of the victims and the public are to guarantee the benign operation of the investigation right, to highlight the basic and original status of the investigation right, and to balance the power limit and the free cutting amount. In this paper, the status and practice of the control of the control of the investigation power are discussed and analyzed, and from the present legal provisions, the control program of the present investigation power is mainly based on the internal control. The examination and supervision of the procuratorial organ is the subsidiary, and the other control forms are the complementary program control mechanism. The internal control of the investigative organ and the supervision procedure of the procuratorial organ have a certain control effect and present a new characteristic. This paper analyzes the defects of the program control of the investigation power in China. Prosecutorial supervision is weak, and the procedural sanction is still defective. There are many defects in the control procedure of the specific authority of the investigation right, such as the examination of the right of the case and the random nature of the supervision procedure, the right of investigation and interrogation in the non-custodial state is not regulated, and the search right is in the form of approval. In this paper, the author puts forward some suggestions to improve the program control of the investigation right in our country. In this paper, we put forward the reform thought and the concrete improvement measures to perfect the control of the procedure of investigation in our country. The whole thinking is to accelerate the formation of the concept of justice and justice of the procedure, to build a procedure for the review of the proceedings, to establish a procedural sanction system and to strengthen the procedure of the investigation of the right of prosecution.
