【摘要】：正中國(guó)社會(huì)科學(xué)院法學(xué)研究所冀祥德教授的著作《控辯平等論》運(yùn)用比較分析、實(shí)證分析和規(guī)范分析的方法,在深度挖掘控辯平等的理論基礎(chǔ)和產(chǎn)生、演進(jìn)過(guò)程的同時(shí),對(duì)其現(xiàn)代內(nèi)涵進(jìn)行了實(shí)質(zhì)性的重新解讀,并以該原則為基點(diǎn)對(duì)控辯關(guān)系進(jìn)行了體系化的重構(gòu),進(jìn)而以原則為主線系統(tǒng)論證了刑
[Abstract]:The theory of equality between prosecution and defense, written by Professor Ji Xiangde of the Institute of Law, Chinese Academy of Social Sciences, uses the methods of comparative analysis, empirical analysis and normative analysis to deeply excavate the theoretical basis, emergence and evolution process of equality of prosecution and defense. This paper makes a substantial reinterpretation of its modern connotation, and makes a systematic reconstruction of the relationship between prosecution and defense on the basis of this principle, and then systematically demonstrates the punishment with the principle as the main line.
