【摘要】：非法證據(jù)排除規(guī)則通常指執(zhí)法人員及其授權(quán)的人員通過非法方法所收集的證據(jù)不得在刑事審判中采納的規(guī)則。當(dāng)前，，我國雖然已經(jīng)在立法上正式確立了非法證據(jù)排除規(guī)則,但非法證據(jù)排除規(guī)則在檢察機(jī)關(guān)所查辦的職務(wù)犯罪案件中遠(yuǎn)未得到落實(shí)。非法證據(jù)排除規(guī)則在職務(wù)犯罪案件中適用面臨著著非法取證定義難、辯方舉證難、檢察機(jī)關(guān)自身排除難、法院排除自由裁量難、相關(guān)配套制度運(yùn)用難等諸多難題，亟須進(jìn)一步完善立法、健全制度、轉(zhuǎn)變理念、提高能力，使非法證據(jù)排除規(guī)則切實(shí)施行。
[Abstract]:The rule of excluding illegal evidence usually refers to the rule that the evidence collected by law enforcement officials and their authorized personnel through illegal methods may not be adopted in criminal trial. At present, although the rule of illegal evidence exclusion has been formally established in the legislation of our country, the rule of illegal evidence exclusion is far from being implemented in the official crime cases investigated by procuratorial organs. The application of the rule of excluding illegal evidence in the case of duty crime faces many difficult problems, such as the definition of illegal evidence collection, the difficulty of proving evidence by the defence, the difficulty of excluding the procuratorial organ itself, the difficulty of ruling out the discretion of the court, the difficulty of using the relevant supporting system, and so on. It is necessary to further perfect the legislation, perfect the system, change the idea, improve the ability to enforce the rule of excluding illegal evidence.
