【摘要】：毒品犯罪誘惑偵查是偵查人員親自或者指使相關人員,人為地為潛在犯罪分子提供實施毒品犯罪提供條件或機會,促使其實施毒品犯罪,從而在自己的掌控之下順利搜集犯罪證據(jù)的過程。在實踐中,誘惑偵查的發(fā)起者自覺或者不自覺地會超越法律和道德的底線適用誘惑偵查制度,侵犯公民的自由和民主權利,給審查起訴帶來了許多難題:第一,毒品犯罪誘惑偵查缺乏統(tǒng)一的法律依據(jù),這體現(xiàn)在一是規(guī)定本制度的規(guī)定法律位階不高,二是都為概括性的模糊概述,沒有明確的實踐指引性;同時,適用的案件范圍不明確,什么類型和罪名的毒品犯罪案件可以適用誘惑偵查制度不明確;第二,適用程序缺乏明確規(guī)范,獲取的證據(jù)如何在審查起訴時運用沒有可借鑒的規(guī)定;第三,對濫用誘惑偵查措施的現(xiàn)象缺乏監(jiān)督,由誰監(jiān)督、如何監(jiān)督,并沒有確定性的指引;當違法誘惑偵查發(fā)生時,如何采取權利救濟措施也無法獲知等。針對以上問題,首先,要從程序法和實體法兩個方面確定毒品犯罪誘惑偵查合法地位和案件適用范圍,在刑事訴訟程序上確定誘惑偵查的確定的、合法的地位,用司法解釋等實體性的規(guī)則規(guī)范誘惑偵查的具體適用原則、方式、范圍等事項;其次,要規(guī)范適用程序和所獲證據(jù)的運用;最后,要加強審查監(jiān)督,不能將誘惑偵查置于偵查機關內(nèi)部程序的層面,防止出現(xiàn)法律的真空地帶;設立違法誘惑偵查的權利救濟機制,保障公民的基本人權,追究違法誘惑偵查的偵查機關、偵查人員的法律和工作紀律方面的責任,從源頭上遏制違法誘惑偵查的行為。
[Abstract]:The enticement investigation of drug crimes is to provide the conditions or opportunities for potential criminals to commit drug crimes, either personally or at the instigation of relevant personnel, in order to promote them to commit drug crimes. Thus under their own control of the smooth collection of criminal evidence process. In practice, the initiators of temptation investigation consciously or unconsciously apply the temptation investigation system beyond the bottom line of law and morality and violate the freedom and democratic rights of citizens, which brings many difficult problems to the review and prosecution: first, The lack of uniform legal basis for the investigation of drug crime temptation is reflected in the fact that the legal rank of the provisions of this system is not high, the second is the vague summary of generality, and the lack of clear practice guidance; At the same time, the scope of applicable cases is not clear, what types and charges of drug crimes can be applied to seductive investigation system is not clear; Second, there is a lack of clear norms in the applicable procedures, how to obtain evidence in the review of prosecution in the use of no reference to the provisions; Third, the phenomenon of abuse of temptation investigation measures is lack of supervision, by whom supervision, how to supervise, there is no definite guidance; when illegal temptation investigation occurs, how to take the right relief measures can not be known, and so on. In view of the above problems, first of all, it is necessary to determine the legal status and applicable scope of the seduction investigation of drug crimes from both the procedural law and the substantive law, and to determine the legal status of the temptation investigation in the criminal procedure. Using substantive rules, such as judicial interpretation, to regulate the specific applicable principles, ways, and scope of seductive investigation; Secondly, it is necessary to standardize the application procedure and the application of the evidence obtained; finally, to strengthen the examination and supervision, the temptation investigation cannot be placed at the level of the internal procedure of the investigation organ, so as to prevent the occurrence of the vacuum zone of the law; To set up the right relief mechanism of illegal temptation investigation, to protect the basic human rights of citizens, to investigate the investigation organs of illegal temptation investigation, to investigate the responsibility of investigators in law and work discipline, and to restrain the behavior of illegal temptation investigation from the source.
