【摘要】：近年來,義烏作為全球最大的小商品市場,涉外商事糾紛時有發(fā)生,由于此類案件的審理周期長、成本高,所以訴訟并非解決糾紛的最佳方式。為此,義烏市司法局專門成立涉外糾紛人民調(diào)解委員會,以商事調(diào)解替代司法訴訟。該委員會依托豐富的司法資源,創(chuàng)新調(diào)解程序與形式,創(chuàng)造性地采用“以外調(diào)外”機制,并配合誠信檔案機制解決了大量商事糾紛,為我國商事調(diào)解提供了新的實踐模式,也為我國商事調(diào)解立法提供了重要的實踐經(jīng)驗。
[Abstract]:In recent years, Yiwu as the world's largest small commodity market, foreign commercial disputes occur from time to time, due to the long trial cycle of such cases, high costs, so litigation is not the best way to resolve disputes. To this end, Yiwu City Judicial Bureau set up a foreign-related disputes people's mediation committee, commercial mediation instead of judicial proceedings. Relying on the abundant judicial resources, innovating the mediation procedure and form, the committee creatively adopted the mechanism of "external transfer" and solved a large number of commercial disputes in cooperation with the good faith file mechanism, which provided a new practical model for commercial mediation in our country. It also provides important practical experience for the legislation of commercial mediation in China.
