【摘要】：正目前在法律層面,關(guān)于如何解決媒體為秘密消息源保密的職業(yè)道德與公民作證的新聞隱匿問題,一項重要建議就是在中國引入"記者拒證權(quán)"(也有的說成"記者隱匿權(quán)"),即在訴訟中,出于為秘密消息源保密與保障輿論監(jiān)督的理由,司法機關(guān)不得強迫記者透露相關(guān)消息來源。筆者認為,"記者拒證權(quán)"的一些技術(shù)思路可以借鑒,但目前國內(nèi)外關(guān)于"記者拒證權(quán)"的爭議還很大。在我國除了律師法規(guī)定"律師不得就其代理案件作證"以外,并沒有授予某一
[Abstract]:At present, at the legal level, there are questions about how to solve the problem of the media's professional ethics of keeping secret information sources and the news hiding of citizens testifying. An important suggestion is the introduction of the "right of refusal of a reporter's certificate" (or "reporter's right to conceal") in China, that is, in litigation, for reasons of keeping secret information sources confidential and safeguarding supervision by public opinion. The judicial organ may not force reporters to disclose relevant sources of information. The author believes that some technical ideas of "reporter's right to refuse a permit" can be used for reference, but at present there is still a great deal of controversy at home and abroad about the "right of refusal of a reporter's certificate". In our country, except for the law on lawyers, which stipulates that "a lawyer may not testify in relation to his representative case", it is not granted to a certain person.
