【摘要】：非法證據(jù)排除規(guī)則能否實施的關(guān)鍵在于立法是否配置一套合理的調(diào)查程序,而合理調(diào)查程序的設(shè)置評價標(biāo)準(zhǔn)之一就是該程序能否被適當(dāng)?shù)貑印Ｑ芯空{(diào)查程序啟動的主體、啟動時間以及啟動時所附隨的證明責(zé)任是確保調(diào)查程序被合理啟動的最為重要的環(huán)節(jié)。針對我國刑事訴訟中非法證據(jù)排除規(guī)則調(diào)查程序啟動中存在的諸多不合理之處,應(yīng)結(jié)合有關(guān)司法解釋進(jìn)行完善。
[Abstract]:Whether illegal evidence exclusion rules can be implemented depends on whether the legislation allocates a set of reasonable investigation procedure, and one of the evaluation criteria of reasonable investigation procedure is whether the procedure can be started properly. It is the most important link to study the subject, the time of starting and the accompanying burden of proof to ensure that the investigation procedure is started reasonably. In view of the irrationality existing in the initiation of the investigation procedure of the rule of exclusion of illegal evidence in criminal proceedings in our country, we should combine the relevant judicial explanation to perfect it.
