【摘要】：案件質(zhì)量指標(biāo)體系是最高人民法院及地方各級人民法院針對我國司法實(shí)踐中較為突出的案件質(zhì)量偏差以及司法公信力日益降低等現(xiàn)實(shí)問題所作的回應(yīng)。然而現(xiàn)行案件質(zhì)量指標(biāo)體系卻呈現(xiàn)出過度的主觀性、沖突性、數(shù)字化以及精細(xì)化等特征,致使其所欲求之目標(biāo)在案件質(zhì)量管理實(shí)踐中日趨異化為扭曲司法活動、悖離司法規(guī)律的制約性制度安排。為了實(shí)現(xiàn)案件質(zhì)量指標(biāo)體系設(shè)置目的,以實(shí)現(xiàn)提升案件質(zhì)量、增進(jìn)司法公正、規(guī)范司法活動的初始目標(biāo),亟需從理念和技術(shù)層面對其予以調(diào)整和完善。
[Abstract]:The index system of case quality is the response of the Supreme people's Court and local people's courts at all levels to the practical problems such as the outstanding deviation of case quality and the decreasing judicial credibility in our country's judicial practice. However, the present index system of case quality has the characteristics of excessive subjectivity, conflict, digitization and refinement, which leads to the increasingly dissimilation of its desired target into distortion of judicial activities in the practice of case quality management. Contrary to the judicial rules of the restrictive system arrangements. In order to achieve the purpose of setting up the index system of case quality, to improve the quality of cases, to promote judicial justice and to standardize the initial goal of judicial activities, it is urgent to adjust and perfect it from the perspective of concept and technology.
