【摘要】：指定居所監(jiān)視居住措施在查辦職務(wù)犯罪等刑事案件中具有重要的促進和保障功能:一是替代羈押功能;二是加強辦案保密功能;三是推動辦案功能。該措施具有以下法律特征:法定性;強制性;臨時性或者變動性。應(yīng)當著重從以下方面完善該措施使用機制:確立使用原則;堅持適用標準;規(guī)范指定的居所;控制使用的時限;加強協(xié)作配合及看管。規(guī)范使用該措施須注意以下問題:一是進一步強化初查環(huán)節(jié)和措施;二是突出抓住看管的關(guān)鍵環(huán)節(jié);三是嚴格依法履行告知義務(wù)。
[Abstract]:The residential surveillance measures of designated residence play an important role in promoting and safeguarding the investigation and handling of criminal cases such as job-related crimes. The first is to replace custody; the second is to strengthen the confidentiality of handling cases; and the third is to promote the function of handling cases. The use mechanism of this measure includes: establishing the principle of use; adhering to applicable standards; standardizing the designated residence; controlling the time limit of use; strengthening cooperation and supervision.
