【摘要】：在基層社會治理中,刑事強(qiáng)制手段存在被濫用的情況:刑事拘留的對象往往被任意擴(kuò)大;刑事拘留的使用目的也往往超出了刑事訴訟的保障功能,經(jīng)常為安撫被害人、公眾而對嫌疑人實施刑事拘留。這與基層政府剛性維穩(wěn)的思路、執(zhí)法人員和公眾法治意識水平不高、相關(guān)法律制度的空白和缺陷都有很密切的關(guān)系。這種刑事強(qiáng)制手段的濫用因考慮了不相關(guān)因素而污染了公權(quán)力的正當(dāng)性源頭、錯誤地引導(dǎo)了公民法治觀念、給少數(shù)人以刑事手段介入民事糾紛創(chuàng)造了機(jī)會,埋下了更深的隱患。以法治手段對此進(jìn)行規(guī)制,有賴于立法上完善刑事拘留的嚴(yán)格適用標(biāo)準(zhǔn);體制上建立刑事追訴目的性審查程序;司法上向前延伸強(qiáng)制措施必要性審查。
[Abstract]:In grass-roots social governance, criminal coercive means are abused: the object of criminal detention is often arbitrarily expanded; the use of criminal detention is often beyond the safeguard function of criminal proceedings, often in order to appease the victim. Criminal detention of suspects by the public. This is closely related to the rigid and stable thinking of the grass-roots government, the low level of law enforcement officers and the public awareness of the rule of law, and the blank and defects of the relevant legal system. The abuse of this kind of criminal coercive means pollutes the legitimate source of public power by considering irrelevant factors, misleads citizens' concept of rule of law, creates opportunities for a few people to intervene in civil disputes by criminal means, and buries deeper hidden dangers. The regulation by means of the rule of law depends on perfecting the strict applicable standards of criminal detention in legislation, establishing the criminal prosecution purpose examination procedure in the system, and examining the necessity of extending the coercive measures forward in the judicial field.
