【摘要】：近年來(lái),在中央的號(hào)召下,國(guó)家在司法系統(tǒng)各個(gè)部門推行一系列改革措施,其中檢察改革是關(guān)鍵性的一步,在檢察系統(tǒng)改革中,辦案模式的改革即主任制是重中之重,它的改革目的主要是去除程序繁雜的行政化,建立起司法系統(tǒng)應(yīng)有的“司法化”運(yùn)行機(jī)制,該項(xiàng)辦案模式具有創(chuàng)新性,與現(xiàn)有辦案模式相比更有辦案效率,有助于提高國(guó)家的司法權(quán)威。在試行的過(guò)程中取得了很多成效,同時(shí)也不可避免出現(xiàn)很多現(xiàn)實(shí)問(wèn)題。文章將運(yùn)用文獻(xiàn)綜述法、理論分析法、對(duì)比研究法和案件分析方法進(jìn)行研究,探討這一制度建立的起因,實(shí)施成效和困境,并借鑒當(dāng)前試點(diǎn)工作的經(jīng)驗(yàn)教訓(xùn),著力于探討如何完善這項(xiàng)制度,以期能夠?qū)@項(xiàng)改革的理論研究和實(shí)踐推進(jìn)有所貢獻(xiàn)。
[Abstract]:In recent years, at the call of the Central Committee, the state has carried out a series of reform measures in various departments of the judicial system, among which the procuratorial reform is a key step. In the reform of the procuratorial system, the reform of the mode of handling cases, that is, the director system, is the most important. The aim of the reform is to remove the complicated administrative procedure and establish the "judicial" operation mechanism of the judicial system. The mode of handling cases is innovative and more efficient than the existing mode of handling cases. It helps to enhance the judicial authority of the country. In the process of trial has made a lot of achievements, but also inevitably a lot of practical problems. The article will use literature review method, theoretical analysis method, contrast research method and case analysis method to study the causes, implementation results and difficulties of this system, and draw lessons from the current pilot work. Try to explore how to perfect this system, in order to contribute to the theoretical research and practice of the reform.
